66-717RESOLUTION NO. 66R-717 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM APPROVING THE ANNEXATION TO THE CITY OF ANAHEIM OF THE TERRITORY KNOWN AND DESIGNATED AS RINKER ANNEXATION NO. 2 WHEREAS, the City Council of the City of Anaheim did on the llth day of October 1966 receive a written petition asking that certain new territory described in said petition be annexed to the City of Anaheim; and WHEREAS, prior to the circulation or filing of said petition, notice of intention to annex said territory, contain- ing the specific boundaries of the territory to be annexed, was filed with the Local Agency Formation Commission, and said Local Agency Formation Commission rendered its decision, as provided in Section 54797 of the Government Code, approving said annexa- tion; and WHEREAS, said territory proposed to be annexed to said City of Anaheim is situated in the County of Orange, State of California, and is contiguous to the City of Anaheim, and is uninhabitited territory. That said petition contained a descrip- tion of said territory in words and figures as hereinafter in this resolution described; and WHEREAS, the City Council duly assembled at a regular meeting of said City Council held on the 1st day of November 19 66 did find that said petition at the time it was filed an received was signed by the owners of not less than one fourth of the land in the terri- tory by area and by assesssed value, as shown on the last pre- ceding equalized assessment roll of the County of Orange, State of California, in which said territory is situated, and that said territory did not form a part of any municipal corporation, and did find that said territory is contiguous to the City of Anaheim and is uninhabited territory; and WHEREAS, on the 1st day of No9vember 19_66 at a regular meeting of said Council of the City of Anaheim, Resolution No. 66R -707 was duly passed and adopted specifically describing the boundaries of the terri- tory so proposed to be annexed to the City of Anaheim, designating such territory as RINKER ANNEXATION NO. 2 giving notice of such annexation and fixing the 15th day of November 19 66 at the hour of 1 :30 o'clock P.M. at the City Council Chamber in the City in the City of Anaheim as the day, hour and place when and where the City Council would hear protests made by any owner of real prop- erty within the City who does not also own property in the terri- tory proposed to be annexed, and directing the City Clerk to publish or cause to be published a copy of said resolution in a newspaper of general circulation, published in the City of Anaheim, to wit: the Anaheim Bulletin of Anaheim, Orange County, California, and directing that said publication be completed at least four (4) days prior to the date of hearing hereinabove mentioned; and further directing the City Clerk of the City of Anaheim to cause written notice such proposed annexation to be mailed to any person who had filed his name and address and the designation of lands in which he has any interest, either legal or equitable, with said City Clerk; and that in the event that land within the territory proposed:to be annexed to the City of Anaheim is owned by a County,:.that the City Clerk should cause written notice of such proposed annexation to be mailed to the Board of Supervisors of such County, and directing that such notices be given not less than twenty (20) days before the first public hearing on the proposed annexation; and WHEREAS, on the hour, day and at the place specified in said Resolution No. 66R -707 to wit: On the 15th day of November 19 66 at the hour of 1 :30 o'clock P.M. in the City CounciIChamber in the City Hall in the City of Anaheim, California, the City Council of the City of Anaheim did meet and assemble to hear and pass on all protests filed or received up to the closing of the hearing on said protests. That the City Council did find that the resolution fixing the time and place of said hearing was published by the City Clerk as therein directed, and that written notice of such proposed annexation was mailed by the City Clerk to each person who had filed his name and address and the designation of lands in which he has any interest, either legal or equitable, with the City Clerk, as directed in said resolution. NOW, THEREFORE, BE IT RESOLVED by the City Council of the of Anaheim that the annexation of the territory in- cludedwithin the boundaries of the particularly described as follows, to wit: kt ;kk more RINKER ANNEXATION NO. 2 That portion of land located in the County of Orange, State of California, described as follows; Beginning at a point in the existing City Limit line of the City of Anaheim, as established by the Rinker Annexation to the City of Anaheim, passed by Ordinance No. 2257, March 8, 1966, filed with the Secretary of State April 11, 1966, and recorded April 12, 1966, in the office of the County Recorder of Official Records of Orange County, California, said point of beginning being the Southeast corner of Parcel No. 2, of the land conveyed to the Placentia Unified School District of Orange County, California, by Final Order of Condemnation, recorded April 18, 1963 in Book 6514, pages 183 and 184 of Official Records of Orange County, California; thence 1. Leaving the said existing City Limit lines of the City of Anaheim, along a portion of the Southerly line of Parcel One of the land conveyed to said Placentia Unified School District, South:84° 25' 39" East 54.88,feet; thence 2. South 5° 34' 21" West 170.01 feet, leaving the Southerly line of the land conveyed to the said Placentia Unified School District to an inter section with the existing City Limit line of the City of Anaheim, as established by the afore mentioned Rinker Annexation, said point of inter- section being in the most Easterly line of said Rinker Annexation,,. distant North 12° 19' 00" West 47.27 feet from the Southeast corner of said Rinker Annexation; thence 3. North 12 19' 00" West 178.65 feet along a portion of the last mentioned existing City Limit line of the City of Anaheim to the point of beginning. is hereby approved and said territory is hereby annexed to and incorporated in the City of Anaheim, County of Orange, State of California, and is hereby designated as the RINKER YNEX TION NO. 2 ANNB &'9N to the City of Anaheim. BE IT FURTHER RESOLVED that from and after the date of the adoption of this resolution 'and the filing of a certi- fied copy thereof with the Secretary of State of the State of California, the annexation of the territory herein described shall be deemed to be and shall be complete and thenceforth such annexed territory shall be, to all intents and purposes, a part of the City of Anaheim, and from and after the effective date of such annexation, all property therein shall be subject to taxation equally with the property within the City of Anaheim and shall be taxed to pay its proportionate share of the existing indebtedness and liability of said City of Anaheim contracted prior to or existing at the time of such annexation pursuant to the written consent of the owners of property in said annexed territory filed with the Clerk of the City of Anaheim prior to the adoption of this resolution. BE IT FURTHER RESOLVED that the City Clerk shall certify to the passage of this resolution and cause the same to be published once in the Anaheim Bulletin, a newspaper of general circulation, printed, published and circulated in the City of Anaheim, County of Orange, State of California.
