A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING AND AUTHORIZING THE
EXECUTION OF AN AGREEMENT BETWEEN THE CITY
OF ANAHEIM AND ORANGE COUNTY WATER DISTRICT
WITH REFERENCE TO A GRANT OF EASEMENT ALONG
ANAHEIM ROAD FOR ROAD AND PUBLIC UTILITY
PURPOSES.
WHEREAS, Orange County Water District is the owner
of the property hereinafter described; and
WHEREAS, the City of Anaheim now finds it is neces-
sary to widen Anaheim Road in order to relieve traffic
congestion which is developing in that portion of the City
adjacent to the hereinafter described property; and
WHEREAS, the Board of Directors of Orange County
Water District has authorized the dedication of an additional
seven -foot strip of land along the north side of Anaheim Road
of said District -owned property to the City of Anaheim for
road and public utility purposes, provided that the City of
Anaheim will agree to bear the cost of installation and main-
tenance of any and all new construction located on said seven
foot strip, together with the cost of relocating any Orange
County Water District owned facilities including, but not
limited to, fences which are located on said seven -foot strip;
and
WHEREAS, Orange County Water District has this day
tendered to the City an agreement dated May 3, 1963, to be
made and entered into by and between the City and Orange
County Water District, wherein said District agrees to and
does grant to the City of Anaheim an easement for road and
public utility purposes over, under and across the hereinafter
described property, subject to certain terms,covenants and
conditions therein set forth; and
WHEREAS, the City Council finds that it would be for
the benefit and best interest of the City to accept said grant
of easement upon the terms and conditions set forth in said
agreement, and that said agreement should be approved.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the agreement dated May 3, 1963,
this day tendered to the City Council by Orange County Water
District, to be made and entered into by and between said
District and the City of Anaheim, wherein said Orange County
Water District agrees to and does grant to the City an ease-
ment for road and public utility purposes over, under and
across the following described property:
The Northerly 7.00 feet of the Southerly 37.00 feet,
as measured from the center line of Anaheim Road, of
that parcel of land described in a Final Order of
Condemnation recorded March 26, 1958 in Book 4239,
page 218 of Official Records of Orange County,
California, described as follows:
The West 77.28 acres of Lot 1 in Block K of the
Kraemer Tract, as shown on a Map thereof recorded
in Book 12, pages 87 and 88 of Miscellaneous Records
of Los Angeles County, California, the Easterly line
thereof being parallel with the West line of said
Lot 1.
EXCEPTING THEREFROM that portion of the West 77.28
acres of Lot 1 in Block K of said Kraemer Tract,
described as follows:
All that portion of said West 77.28 acres lying
Southeasterly of the arc of a curve concave North-
westerly and having a radius of 500.00 feet, said
curve being tangent to the East line of said West
77.28 acres and tangent to a line parallel with
the center line of the 40.00 foot wide road shown
on said map, along the Southerly side of said lot,
and distant Northerly 20 feet therefrom;
subject to the terms, covenants and conditions therein contained,
be and the same is hereby approved and accepted.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
be, and they are hereby, authorized to sign said agreement for
and on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by
me this 14 th day o May 1963.

AND I FURTHER CERTIFY that the Mayor of the City of
Anaheim approved and signed said Resolution No. 63R -410 on the
