63-0401RESOLUTION NO. 63R -401 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Pro- ceedings No. 62 -63 -102 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings, and recommendation of the City Planning Commission the City Council did fix the 14th day of May 19 63 as the time and the City Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said prop- erty, hereinafter described, from the zone or zones in which it is now situated, and the incorporation thereof in the zone or zones hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing, and did give all persons interested therein an oppor- tunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: 62 -63 -102 All that certain real property situated in the South- east quarter of Section 26, in Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, in the City of Anaheim, as said section is shown on a map thereof recorded in Book 51, page 10, Miscellaneous Maps, records of said Orange County, described as follows: Beginning at the Northwest corner of said Southeast quarter; thence Easterly 610.50 feet along the North line of said Southeast quarter to the Southwesterly line of the right of way of the Southern Pacific Rail- road; thence South 40 50' 45" East 793.05 feet along said Southwesterly right of way line to the most North- erly corner of land described in Certificate No. 6495 in the office of the Registrar of Titles of said Orange County; thence South 71 35' 00" West 54.32 feet along the Northwesterly line of the land covered by said Certificate, to the Northwesterly corner of the land described in deed to the State of California recorded October 5, 1954, in Book 2834, page 192, Official Records, said point being on a curve concave Southwest- erly and having a radius of 2458.00 feet; thence South- easterly 609.70 feet along said curve and along the Easterly line of said land described in deed to the State of California, from a tangent which bears South 40 18' 11" East through a central angle of 14 12' 43"; thence tangent to said curve South 26 05' 28" East 248.98 feet to the beginning of a tangent curve concave Northeast- erly and having a radius of 2042.00 feet; thence South- easterly 131.55 feet along said curve through an angle of 3 41' 28" to the true point of beginning; thence South 49 12' 00" West 282.24 feet; thence South 40 48' 00" East 76.64 feet to the Southeasterly line of the land described in said Certificate No. 6495; thence North 71 40' 00" East to the Southwesterly corner of said State of California land; thence Northerly along the Southwesterly line of said State of California land being a curve concave Northeasterly and having a radius of 2042.00 feet through an angle of 5 10' 11 a distance of 184.25 feet to the true point of beginning; be excluded from R -A, RESIDENTIAL- AGRICULTURAL ZONE, and incor- porated in C -1, NEIGHBORHOOD- COPM2ERCIAL ZONE, upon the following conditions: 1. (a) That all engineering requirements of the City of Anaheim along Manchester Avenue, including pre- paration of improvement plans and installation of all improvements, such as curbs and gutters, side- walks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifica- tions on file in the Office of the City Engineer; and (b) that a bond in an amount and form satis- factory to the City of Anaheim shall be posted with the City to guarantee the installation of said engineering requirements. 2 ATTEST: 2. That the owner of subject property shall pay, to the City of Anaheim the sun of $2.00 per front foot, along Manchester Avenue, for street lighting purposes. 3. That, trash storage; areas shall be provided in accordance with standard plans on file in the Office of the. Director of Public Works_ and_ Superintendent of Streets, prior to final building inspection. 4. That a 6 -foot masonry wall shall be constructed along the north, west and south boundaries of subject property, prior to final building in- spection. 5. That tree wells shall be provided at 40 -foot intervals in_ the „parkway portion of the Man- chester Avenue right of way,, and that a strip of land of a minimum width of 6 feet abutting the Manchester Avenue property line shall be landscaped and said landscaping maintained; that plans for said landscaping shall be sub- mitted to and approved by the Superintendent of Parkway Maintenance; and that said landscaping shall be installed prior to final building inspection. 6. That subject property shall be developed sub- stantially in accordance with Exhibits Nos. 1, 2 and 3, as amended herein, on file with the City of Anaheim. 7. That Conditions Nos. 1(b) and 2 above mentioned shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and deter- mined to be necessary and proper.
