63-0397RESOLUTION NO. 63R 397 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING VARIANCE NO. 1566 WHEREAS, the City Planningq Commission of the City of Anaheim did receive a petition for stoning variance from RAY W. GRIMM owner o cer a n rea proper y s uated m e ity o Anae m, County of Orange, State of California, described as follows: The northeast quarter of the northeast quarter of the northwest quarter of Section 13, Town- ship 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, City of Anaheim, County of Orange, State of California, as said Section is shown on a map recorded in Book 51, page 7 of Miscellaneous Maps, in the office of the County Recorder of said County. EXCEPT the West 198.00 feet thereof. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on A ril 15 19 63 notice of which said public hearing was uu given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said City Planning Commission after due inspection, investigation_and studies made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, did adopt Resolution No. 721 Series 1 9 69 63 9 denying Variance No. 1566 and WHEREAS, thereafter within twenty-two (22) days from the date of the adoption of said resolution, the. City Council did elect, upon its own motion, to review the action taken by the City Planning Commission in denvin said variance and did set a pu blic hearing thereon to be held on the 14th day of Ma y 1963 at 7:00 o'clock P.M. in the City Hall in the of Anaheim, and notice of such public hearing was duly given as required by law and the provisions of Title 18,_Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, the City Council does find that: 1. There is.no_substantial property right, possessed by other property in the same vicinity and zone and denied the subject property. 2. It appears that the subject property can be adequately developed and used under the present zone. THEREF ©RE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commission -1- denying Variance No. 1566 be, and the same is hereby sustained, and that the petition of Ray W. Grimm, 1951 Ravista Lane, La Canada, California, for a variance permitting a waiver of the one -story height limitation and a waiver of the block wall re- quirement, as required by the Anaheim Municipal Code, on the property hereinabove described, be, and the same is hereby denied.
