63-0381RESOLUTION NO. 63R -381 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Pro- ceedings No. 62 -63 -95 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings, and recommendation of the City Planning Commission the City Council did fix the 7th day of May 19 63 as the time and the City Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said prop- erty, hereinafter described, from the zone or zones in which it is now situated, and the incorporation thereof in the zone or zones hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing, and did give all persons interested therein an oppor- tunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: 62 -63 -95 PARCEL NO. 1: That portion of the Northwest quarter of the Northwest quarter of Section 13, Township 4 South, Range 11 West in the Rancho Los Coyotes, as said Section is shown on the map recorded in Book 51, Page 11 of Miscellaneous Maps, records of said County, described as follows: Commencing at the Northeast corner of Tract 4261, per map thereof recorded in Book 161, Pages 41 to 43 inclusive of Miscellaneous Maps, records of said County; thence North 89 41' 15" East, along a line parallel with the North line of said Section 13, and distant Southerly therefrom 66.00 feet, measured at right angles, a distance of 23.94 feet to the true point of beginning of the boundary of the land herein described; thence, continuing along said parallel line, North 89 41' 15" East 283.16 feet to a line parallel with the West line of said Section and distant Easterly 978.00 feet there- from, measured along said North line; thence South 0 10' 15" East along said parallel line, 275.00 feet; thence South 89 41' 15" West, parallel with said North line 293.06 feet to the beginning of a tangent curve concave Northeasterly and having a radius of 15.00 feet; thence Northwesterly, along said curve, through a central angle of 69 06' 28 a distance of 18.09 feet to the East line of said Tract 4261; thence North 0 10' 15" West, along said East line, 247.41 feet to a point on a curve concave Southeasterly and having a radius of 25.00 feet a radial line of said curve bears North 73 54' 38�' West; thence Northeasterly, along said curve, through a central angle of 73 35' 53', a distance of 32.11 feet to the true point of beginning. PARCEL NO. 2: That portion of the Northwest quarter of the Northwest quarter of Section 13, Township 4 South, Range 11 West in the Rancho Los Coyotes, as said Section is shown on the map recorded in Book 51, Page 11 of Miscellaneous Maps, records of said County, described as follows: Beginning at the point on the East line of Tract 4261, per map thereof recorded in Book 161, Pages 41 to 43 inclusive of Miscellaneous Maps, records of said County, distant South 0 10' 15" East 265.35 feet from the Northeast corner of said Tract; thence Southeasterly along the arc of a non tangent curve concave Northeasterly and having a radius of 15.00 feet, from a tangent which bears South 21 12' 37" East, through a central angle of 69 06' 28 a distance of 18.09 feet; thence tangent to said curve, and parallel with the North line of said Section, North 89 41 15" East 293.06 feet to a line parallel with the West line of said Section and distant Easterly 978.00 feet therefrom, measured along said North line; thence South 0 10' 15" East, along said parallel line, 697.83 feet to the North- westerly line of land conveyed to the Orange County Flood Control District by deed recorded in Book 4810, Page 363 of Official Records, records of said County; thence South 57 49' 45" West 362.12 feet to said East line; thence North 0 10' 15" West, along said East line, 898.62 feet to the point of beginning. -2- be excluded from R -A, RESIDENTIAL AGRICULTURAL ZONE, and C -1, NEIGHBORHOOD COMMERCIAL ZONE, and incorporated in the following zones upon the conditions hereinafter set forth: That Parcel No. 1 shall be changed to and in C -1, NEIGHBORHOOD COMMERCIAL ZONE; and That Parcel No. 2 shall be changed to and in R -3, MULTIPLE FAMILY RESIDENTIAL ZONE. incorporated incorporated That said changes of zones shall be made upon the following conditions: 1. That a final tract map of subject property shall be recorded in the Office of the Orange County Recorder. 2. That the owners of subject roperty shall pay to the City of Anaheim the sum of $25.00 per dwelling unit, to be used for park and recreation purposes, said amount to be paid at the time the building permit is issued. 3. That adequate areas for trash storage, accessible to trash -truck pickup, shall be provided as determined and required by the Street Maintenance and Sanitation Division of the Public Works Department, which areas shall be enclosed by a solid fence or wall prior to final building inspection. 4. That subject property shall be developed substantially in accordance with Exhibits Nos. 1, 2 and 3, as amended herein, on file with the City of Anaheim. 5. That plans for the development of subject property, both the C -1 and R -3 portions, shall be subject to approval of the Development Review Board. 6. That a strip of land of a minimum width of six feet, abutting the planned highway right of way line of Lincoln Avenue and abutting the street to the west, shall be landscaped and said landscaping maintained; that tree wells shall be installed at 40 -foot intervals in the parkway portion of Lincoln Avenue; that plans for said landscaping shall be submitted to and approved by the Superintendent of Parkway Maintenance; that plans for said tree wells shall be subject to the approval of the State Highway Department; and that said landscaping and tree wells shall be installed prior to final building inspection. 7. That a six -foot masonry wall shall be constructed along the southerly boundary of Parcel No. 1, prior to final building inspection. 8. That the completion of these reclassification proceedings is contingent upon the granting of Variance No. 1561. BE IT FURTHER RESOLVED that the City Attorney be and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and deter- mined to be necessary and proper.
