63-0378RESOLUTION NO. 63R -378 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Pro- ceedings No. 62 -63 -92 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings, and recommendation of the City Planning Commission the City Council did fix the 7th day of Ma 1963 as the time and the City Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said prop- erty, hereinafter described, from the zone or zones in which it is now situated, and the incorporation thereof in the zone or zones hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing, and did give all persons interested therein an oppor- tunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: -1- 62 -63 -92 Commencing at a point in the Northerly line of Lot 21 of the J. D. Taylor Tract, as shown on a map thereof recorded in Book 36, page 58, Mis- cellaneous Records of Los Angeles Count, California; said point bearing North 73 31' East 292.45 feet from the Northwest corner of said Lot; thence North 73 31' East 350.55 feet, along the Northerly line of said Lot 21 to the Northwest corner of a tract described in deed recorded in Book 207, page 235, Deeds, records of said Orange County; thence along the West line of said tract as follows: South 49 18' East 131 feet; thence South 12 18' East 160 feet; thence South 47 10' East 353.34 feet to an intersection with the tangent line of curve course No. 22 of Riverside Road, Section 3, as laid out and paved by the Orange County Highway Commission, said point bearing South 44 20' West 65.41 feet from the point of intersection of said course No. 22; thence South 44 20' West 364.52 feet; thence North 36 23' West 799 feet to the point of beginning. EXCEPT that portion lying South of the North bank of the Santa Ana Valley Irrigation Company's Canal; be excluded from R -A, RESIDENTIAL- AGRICULTURAL ZONE, and incor- porated in R -3, MULTIPLE FAMILY RESIDENTIAL ZONE, upon the follow- ing conditions: 1. That the owner of subject property shall pay to the City of Anaheim the sum of $25.00 per dwell- ing unit, to be used for park and recreation purposes, said amount to be paid at the time the building permit is issued. 2. That a final tract map of subject property shall be recorded in the Office of the Orange County Recorder. 3. That adequate areas for trash storage, accessible to trash -truck pickup, shall be provided as deter- mined and required by the Street Maintenance and Sanitation Division of the Public Works Department, which areas shall be enclosed by a solid fence or wall prior to final building inspection. 4. That the owner of subject property shall place of record City of Anaheim R -3 Deed Restrictions, approved by the City Attorney, which restrictions shall provide that plans for the development of subject property shall be submitted to the Develop- ment Review Board for approval, prior to the issuance of a building permit. 5. That a 6 -foot masonry wall shall be constructed along the north and east property lines of subject property, prior to final building inspection. 2 ATTEST: BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and deter- mined to be necessary and proper.
