63-0376RESOLUTION NO. 63R -376 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Pro- ceedings No. 62 -63 -81 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings, and recommendation of the City Planning Commission the City Council did fix the 7th day of Mal/ 1963 as the time and the City Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said prop- erty, hereinafter described, from the zone or zones in which it is now situated, and the incorporation thereof in the zone or zones hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing, and did give all persons interested therein an oppor- tunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: -1- 62 -63 -81 Lots 17, 18 and a portion of Lot 6 of the J. D. Taylor Tract, as shown on a map recorded in Book 36, pages 58, 59 and 60 of Miscellaneous Records of Los Angeles County, California, together with those portions of Glen Avenue and Cross Avenue, vacated by Order of the Board of Supervisors on March 12, 1907, and that portion of the County Road adjacent to Lot 17, vacated by Order of the Board of Supervisors of Orange County, on January 27, 1931, more particularly described as follows: Beginning at the most Westerly corner of said Lot 6; thence South 17 00' 45" East 7.32 feet along the Westerly line of said Lot 6 to a point on a curve, non tangent and concave Southerly, having a radius of 1240.00 feet from which a radial line bears South 4 37' 03" West, said point being the true point of beginning; thence Easterly along said curve a distance of 107.95 feet through a central angle of 4 59' 17" to a point of reverse curve, a radial line of said reverse curve at said point bears North 9 36' 20" East, said reverse curve being concave Northerly and having a radius of 1160.00 feet; thence continuing Easterly along said reverse curve a distance of 324.52 feetthrough a central angle of 16 01' 45" to a point on a curve, nontangent and concave Southwesterly, having a radius of 1200.00 feet from which a radial line of said last mentioned non tangent curve bears South 44 32' 13" West; thence South- easterly along said last mentioned nontangent curve a distance of 595.87 feet through a central angle of 28 27' 02" to a point on a tangent line said tangent line also being a Northwesterly prolongation of the center line of Cross Street, as shown on the Map of said J. D. Taylor Tract; thence South 17 00' 45" East 1093.48 feet along said center line prolongation; thence South 17 53' 15" West 86.72 feet; thence North 72 06' 45" West 145.96 feet to a point on a curve, tangent and concave Southerly, having a .radius of 600.00 feet; thence Westerly along said tangent curve 185.01 feet through a central angle of 17 40' to a tangent line; thence North 89 46' 45" West 225.24 feet along said tangent line to a point on the Westerly line of said Lot 17; thence North 17 00' 45" West 1652.37 feet along the Westerly line of said Lots 17, 18 and 6 to the true point of beginning. be excluded from R- A,RESIDENTIAL- AGRICULTURAL ZONE, and incorpo- rated in R -3, MULTIPLE- FAMILY RESIDENTIAL ZONE, upon the following conditions: 1. That a final tract map of subject property shall be recorded in the Office of the Orange County Recorder. 2. That the owner of subject property shall pay to the City of Anaheim the sum of $25.00 per dwelling unit, to be used for park and recreation purposes, said amount to be paid at the time the building permit is issued. 3. That adequate areas for trash storage, accessible to trash -truck pickup, shall be provided as deter- mined and required by the Street Maintenance and Sanitation Division of the Public Works Department, which areas shall be enclosed by a solid fence or wall prior to final building inspection. 4. That subject property shall be developed substan- tially in accordance with Exhibits Nos. 1, 2, 3 and 4 on file with the City of Anaheim, and in accordance with all R -3, Multiple- Family Residential Zone, Code requirements. 5. That a six -foot masonry wall shall be constructed along the west boundary of subject property prior to final building inspection. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
