A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING AND AUTHORIZING THE
EXECUTION OF AN AGREEMENT BETWEEN THE CITY OF
ANAHEIM AND THE CITY OF GARDEN GROVE WITH
REFERENCE TO THE INSTALLATION AND MAINTENANCE
OF A TRAFFIC SIGNAL AND INTERSECTION LIGHTING
SYSTEM AT THE INTERSECTION OF ORANGEWOOD
AVENUE AND EUCLID STREET.

WHEREAS, considerable traffic congestion exists and is
progressively increasing at the intersection of Orangewood Avenue
and Euclid Street, a portion of which intersection is in the City
of Anaheim and a portion of which is in the City of Garden Grove;
and
WHEREAS, the Cities of Anaheim and Garden Grove contem-
plate the installation of a traffic signal and intersection light-
ing system at said intersection, and desire to provide for the
installation of said traffic signal and the maintenance functions
that are to be performed by said Cities and to specify the pro-
portionate share of the costs that are to be borne by each of said
Cities.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the agreement this day submitted to the
City Council to be made and entered into by and between the City
of Anaheim and the City of Garden Grove, providing for the in-
stallation and maintenance of a traffic signal and intersection
lighting system at the intersection of Orangewood Avenue and
Euclid Street, upon the terms and conditions hereinafter set
forth, and specifying the proportionate share of the costs to be
borne by each of said Cities, be and the same is hereby approved.
That the terms and conditions of said agreement are as follows:
1. The CITY OF GARDEN GROVE shall:
A. Prepare the detailed plans, specifications and
estimate for said traffic signal and lighting
system, and associated road work.
B. Prepare map and deed for all necessary additional
right of way.
C. Have jurisdiction of the construction area within
the CITIES OF ANAHEIM AND GARDEN GROVE.
D. Be designated as the contracting and construction
agent for the parties to do and perform all acts
and things necessary or required in order to con-
struct said traffic signal and lighting system in
accordance with the plans and specifications, in-
cluding material control, inspection of the
construction work, and to execute and deliver all
documents necessary or required in connection
with the construction and completion of said
traffic signal and lighting system, including
certificate of day labor, equipment and material
costs, and certification of completion of said
work.

2. The CITY OF ANAHEIM shall:
A. Approve plans and specifications as to design
and construction features affecting the con-
struction, operation and maintenance of the
portion of said traffic signal and lighting
system within the CITY OF ANAHEIM.
B. Approve map and deed of right of way and make
all the necessary arrangements to acquire the
right of way for its portion of said signal
and lighting system and shall, by appropriate
resolution of the City Council so certify to
the CITY OF GARDEN GROVE, prior to the GARDEN
GROVE CITY COUNCIL approving the plans and
specifications, that such acquisition has been
accomplished.
C. At all times during the progress of construc-
tion have access to the work for the purpose
of inspection thereof and should the CITY OF
ANAHEIM deem any remedial measures to be
necessary, it shall notify the CITY OF GARDEN
GROVE thereof.
3. Upon completion of said project, any and all road
work necessary in connection therewith shall be paid
for by the respective parties on the basis of the
actual work done within the limits of their respec-
tive jurisdictions.
4. Upon completion of said project, ANAHEIM'S share of
the installation of the traffic signal and intersec-
tion lighting system will be determined in the same
ratio to the total cost of such system as the number
of legs under ANAHEIM'S jurisdiction entering the
intersection are to the total number of legs enter-
ing the intersection.
5. For the purpose of determining the proportionate
share of the costs to be borne by the respective
parties the City Limits of ANAHEIM and the number
of legs entering the intersection under the jurisdic-
tion of ANAHEIM shall be established as those exist
ing at the time the GARDEN GROVE CITY COUNCIL adopts
the resolution approving the project plans and speci-
fications for advertising for bids.
6. Upon completion of said project, the CITY OF GARDEN
GROVE agrees to submit full, true and correct copies
of documents, certificates and itemized bills to the
CITY OF ANAHEIM, and the CITY OF ANAHEIM shall
reimburse GARDEN GROVE within 30 days upon submission
of statement of such costs for the full cost of the
construction as defined in paragraphs numbered 3 and
4 hereof.
7. All construction and installation costs shall be
based on the contract unit cost.
8. ANAHEIM'S share of the design, survey and construc-
tion engineering costs shall be 107 of ANAHEIM'S
proportionate share of the construction and installa-
tion contract costs.

9. After the completion of said project, the traffic
signals shall be maintained by the CITY OF GARDEN
GROVE and the CITY OF ANAHEIM shall pay to GARDEN
GROVE upon submission of said costs the maintenance
and energy costs in the same ratio to the total cost
as the number of legs under ANAHEIM'S jurisdiction
entering the intersection are to the total number of
legs entering the intersection.
BE IT FURTHER RESOLVED that the Mayor and City Clerk be
and they are hereby authorized to execute said agreement for and
on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by me
this 7th day of May 1963.
