A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AUTHORIZING THE PURCHASE AND ACQUI-
SITION OF CERTAIN REAL PROPERTY FOR MUNICIPAL
PURPOSES.

WHEREAS, HERMAN H. FREESE, as his separate property,
as to an undivided 1/3 interest, GERTRUDE M. HOAGLAND, as her
separate property, as to an undivided 1/3 interest, BARBARA J.
RESLER and BONNIE J. SCHAPER, as to an undivided 1/3 interest,
and CLARA E. FREESE, as to a life estate, are the owners of
the hereinafter described real property situated in the City of
Anaheim, County of Orange, State of California; and
WHEREAS, said owners have offered to sell said pro-
perty to the City of Anaheim for the sum of $200.00 cash, lawful
money of the United States; and
WHEREAS, the City Council does find and determine that
public convenience and necessity require the purchase and acqui-
sition of said real property for municipal purposes, and that
the price which the owners thereof are willing to accept is
reasonable and not out of proportion to the fair market value of
said property.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the offer of said HERMAN H. FREESE,
GERTRUDE M. HOAGLAND, BARBARA J. RESLER, BONNIE J. SCHAPER and
CLARA E. FREESE, to sell to the City of Anaheim all that real
property situated in the City of Anaheim, County of Orange, State
of California, described as follows, to wit:
An undivided 4/59th interest in the real property
described as:
That portion of the Northwest 1/4 of the Northeast
1/4 of Section 17, Township 4 South, Range 10 West,
in the Rancho Los Coyotes as said Northeast 1/4 is
shown on a map of Tract No. 647, Map 29, Page 34 of
Miscellaneous Maps of Orange County, California,
described as follows:
Beginning at a point 665.5 feet South of the North-
east corner of the East 20 acres of the Northwest
1/4 of the Northeast 1/4 of said Section 17; thence
at right angle West 25 feet; thence at right angle
South 65 feet; thence at right angle East 25 feet;
and thence at right angle North 65 feet to the point
of beginning;;
for the sum of $200.00 cash, lawful money of the United States,
be, and the same is hereby, accepted subject to the following
terms and conditions:
That said property shall be conveyed to the City of
Anaheim free and clear of all encumbrances except
all general and special taxes for the fiscal year
1963 -64, and all covenants, conditions, restrictions,
reservations, rights, rights of way and easements of
record approved by the City Attorney.

BE IT FURTHER RESOLVED that the City Auditor be, and
he is hereby, authorized to pay to the owners of said real pro-
perty the sum of $200.00 cash, lawful money of the United States,
when a deed conveying said property to the City of Anaheim free
and clear of all encumbrances, except as hereinabove set forth,
can be accepted by the City Council and recorded.
THE FOREGOING RESOLUTION is approved and signed by me
this 7th day of May, 1963.

adopted at a regular meeting of the City Council

AND I FURTHER CERTIFY that the Mayor of the City of
