63-0305RESOLUTION NO. 63R -305 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE CHANGED; AND RESCINDING RESOLUTION NO. 62R -971. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Pro- ceedings No. 61 -62 -123 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to con- sider a change in the boundaries of the zone or zones herein- after mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon the Planning Commission did duly adopt a reso- lution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of the report and recommendation of the City Planning Commission the City Council did thereupon fix the 30th day of October, 1962 as the time and the Council Chamber in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed change of zones and did give notice thereof in the manner and as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did duly hold and conduct such hear- ing, and did find and determine that the property and area proposed to be changed to different zones, as set forth in said resolution and hereinafter set forth, was more suitable for the zone in which it was incorporated and did, therefore, adopt Resolution No. 62R -971 denying said change of zones; and WHEREAS, thereafter a new application and revised plans were filed with the City of Anaheim under Reclassifica- tion No. 62 -63 -72 covering the same property described in the above mentioned Reclassification No. 61 -62 -123; and WHEREAS, the City Planning Commission did hold a public hearing in Reclassification Proceedings No. 62- 63 -72, after giving due notice thereof as required by law, and did adopt its Resolution No. 644, Series 1962 -63 recommending to the City Council that the property and area therein described be changed to different zones as set forth in said resolution; and WHEREAS, the City Council did fix a time and place for a public hearing on said proposed change of zones under Reclassification No. 62- 63 -72, and did hold said hearing, -1- 61 -62 -123 and give all persons interested therein an opportunity to be heard, and did defer action on said reclassification to April 16, 1963, to be considered in conjunction with a re- hearing on the original application under Reclassification No. 61 -62 -123; and WHEREAS, on April 16, 1963, in the City Council Chamber in the City Hall, City of Anaheim, the time and place fixed for the rehearing on Reclassification No. 61 -62 -123, in conjunction with Reclassification 62- 63 -72, the City Council did find that the property described in said reclassification proceedings and hereinafter described, should be excluded from the zone in which it is now situated and incorporated in the zones hereinafter set forth as recommended by the City Planning Commission in Reclassification No. 61 -62 -123; and that Resolution No. 62R -971 denying said change of zones should be rescinded; and WHEREAS, the City Council does find that the petition for reclassification of said property under Reclassification No. 62 -63 -72 was withdrawn by the applicant. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: PARCEL 1: The South 333 feet of the West 976 feet of the Southwest Quarter of the Southwest Quarter of Section 13, Town- ship 4 South, Range 10 West in the Rancho San Juan Cajon de Santa Ana, in the City of Anaheim, County of Orange, State of California. EXCEPT the South 203 feet of the West 203 feet. PARCEL 2: The South 500 feet of the West 590 feet of the South- west Quarter of the Southwest Quarter of aforementioned Section 13. EXCEPT the South 333 feet. PARCEL 3: The Southwest Quarter of the Southwest Quarter of Section 13, being a portion of Lot 41 in Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, in the City of Anaheim, County of Orange, State of California, as per map recorded in Book 2, pages 256 and 257 of Patents of Los Angeles County, California. EXCEPT THEREFROM the North 20 acres. ALSO EXCEPT the South 500 feet of the West 590 feet. ALSO EXCEPT the South 333 feet of the West 976 feet. -2- be excluded from R -A, RESIDENTIAL AGRICULTURAL ZONE, and incor- porated in the following zones upon the conditions hereinafter set forth: That Parcels 1 and 2 above described be changed to and incorporated in C -1, NEIGHBORHOOD COMMERCIAL ZONE; and That Parcel 3 above described be changed to and incorporated in R -3, MULTIPLE FAMILY RESIDENTIAL ZONE. That said change of zones shall be made upon the following conditions: 1. That the final tract map of subject property shall be recorded in the Office of the County Recorder of Orange County, California. 2. That the owner of subject property shall pay to the City of Anaheim the sum of $25.00 per dwelling unit, to be used for park and recreation purposes, said amount to be paid at the time the building permit is issued. 3. That adequate areas for trash storage, accessible to trash -truck pickup, shall be provided as deter- mined and required by the Street Maintenance and Sanitation Division of the Public Works Department for both the C -1 and R -3 developments, which areas shall be enclosed by a solid fence or wall prior to final building inspection. 4. That the owners of subject property shall place of record City of Anaheim R -3 Deed Restrictions, approved by the City Attorney, covering the R -3 area, which restrictions shall limit the height of all structures constructed on said R -3 property to one story. 5. That a six -foot masonry wall shall be constructed along the north and east boundaries of subject property, unless said wall is specifically waived, in writing, by the abutting property owners; and that said wall, if not waived, shall be constructed prior to final building inspection. 6. That a six -foot masonry wall shall be constructed on subject property as follows: Commencing at a point on Ball Road 284 feet west of the east property line, thence north 259.8 feet; thence west 377 feet; thence north 145 feet; thence west 501.1 feet to the westerly property line on State College Boulevard. 7. That landscaping shall be installed and maintained along the north side of the most northerly block wall, as mentioned in Condition No. 6 hereof. 8. That a strip of land of a minimum width of six feet shall be landscaped and said landscaping maintained along the State College Boulevard and Ball Road rights -of -way abutting subject property; that plans for said landscaping shall be submitted to and approved by the Superintendent of Parkway Maintenance; and that said landscaping shall be installed prior to final building inspection of any structures erected on the C -1 property. 9. That subject property shall be developed sub- stantially in accordance with plans on file with the City of Anaheim marked "Exhibit No. 1 10. That plans for all commercial buildings shall be subject to review by the Architectural Control Committee; provided, however, that the north and east elevations of the proposed commercial buildings shall be compatible with the projected multiple- family residential development. 11. That the owner of subject property shall place of record City of Anaheim C -1 Deed Restrictions, approved by the City Attorney, covering the C -1 portion of subject property. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper. BE IT FURTHER RESOLVED that Resolution No. 62R -971 is hereby rescinded. THE FOREGOING RESOLUTION is signed and approved by me this 16th day of April, 1963.
