63-0281RESOLUTION NO, 63R 281 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceedings No, 62 to consider an amendment to Title lb of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evi- dence, report of findings and recommendation of the City Planning Commission the City Council did fix the att._.- day of April 1963 as the time and the City Council Chambers in the City Hall of tie City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated, and the incorporation thereof in the zone or zones hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing, and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: PORTION "A": The South one -half of the Southwest quarter of the Southwest quarter of the Northwest quarter of Section 14, Township 4 South, Range 11 West, San Bernardino Base and Meridian, in the City of Anaheim, County of Orange, State of California, 62 -63 -63 EXCEPTING THEREFROM the Easterly 159 feet thereof. ALSO EXCEPTING THEREFROM the Southerly 195 feet of the Westerly 203 feet thereof. PORTION "B The Southerly 195 feet of the Westerly 203 feet of the South one -half of the Southwest quarter of the Southwest quarter of the Northwest quarter of Section 14, Township 4 South, Range 11 West, San Bernardino Base and Meridian, in the City of Anaheim, County of Orange, State of California. be excluded from R -A, RESIDENTIAL AGRICULTURAL ZONE and incor- porated in the following zones, upon the conditions hereinafter set forth: That Portion "A" of the real property above described shall be changed to R -3, MULTIPLE FAMILY RESIDENTIAL ZONE; and That Portion "B" of the real property above described shall be changed to C -1, NEIGHBORHOOD COMMERCIAL ZONE. That said change of zones shall be made upon the following conditions: 1. That the owners of subject property shall deed to the City of Anaheim a strip of land 53 feet in width, from the center line of the street, along Knott Avenue for street widening purposes. 2. That the owners of subject property shall deed to the City of Anaheim a strip of land 45 feet in width, from the center line of the street, along Orange Avenue for street widening purposes. 3. (a) That all engineering requirements of the City of Anaheim along Knott and Orange Avenues, including preparation of improvement plans and installation of all improvements, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of said engineering requirements. 4. That the owners of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot, along Knott and Orange Avenues, for street lighting purposes. 5. That the owners of subject property shall pay to the City of Anaheim the sum of $25.00 per dwelling unit, to be used for park and recreation purposes, said amount to be paid at the time the building permit is issued. -2- 6. That adequate areas for trash storage, accessible to trash -truck pickup, shall be provided as deter- mined and required by the Street Maintenance and Sanitation Division of the Public Works Department, which areas shall be enclosed with a solid fence or wall prior to final building inspection. 7. That fire hydrants shall be installed as required and determined necessary by the Chief of the Fire Department, and that said fire hydrants shall be installed prior to final building inspection. 8. That Portion "A" of subject property shall be developed substantially in accordance with Exhibits Nos. 1, 2, 3 and 4, Revision No. 1, on file with the City of Anaheim. 9. That plans for the development of Portion "B" of subject property shall be subject to the approval of the Development Review Division of the Planning Department before the issuance of a building permit; and that said plans shall provide for parkway trees at 40 -foot intervals, and for a landscaped strip of a minimum width of six feet abutting the Orange and Knott Avenues property lines of said portion. 10. That the rear and side walls of the proposed carports shall be stuccoed; that enclosed storage cabinets shall be provided at the rear wall of each carport; that adequate bumper guards shall be provided to protect the interior walls of the proposed carports; and that all of said items shall have been complied with or completed before final building inspection. 11. That the completion of these reclassification proceedings is contingent upon the granting of Conditional Use Permit No. 354. 12. That Conditions Nos. 1, 2, 3(b) and 4 above mentioned shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
