A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM ACCEPTING A GRANT DEED CONVEYING
TO THE CITY OF ANAHEIM CERTAIN REAL PROPERTY
FOR MUNICIPAL PURPOSES, AND AN EASEMENT DEED
FOR DRAINAGE PURPOSES.

WHEREAS, the City Council of the City of Anaheim
did heretofore, by resolution duly adopted on April 10, 1962,
authorize and direct the initiation of condemnation proceed-
ings, which resulted in the commencement of Orange County
Superior Court Case No. 103478, bein entitled "City of
Anaheim vs. Alvin F. Siewert, et al."; and
WHEREAS, Alvin F. Siewert, defendant to said
litigation and owner of the property sought to be condemned,
offered to sell and convey said property to the City, to-
gether with an easement for drainage purposes over, under
and across certain property hereinafter described, for the
sum of $135,000.00; and
WHEREAS, the City Council did on March 26, 1963,
adopt its Resolution No. 63R -239 finding and determining
that said offer was fair and reasonable and should be accepted
and said sum paid to said defendant upon receipt of good
and sufficient deeds conveying said property and said ease-
ment for drainage purposes to the City of Anaheim; and
WHEREAS, said defendant has this day submitted
deeds to the City Council conveying said real property and
said easement to the City.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the Grant Deed this day submitted
to the City Council by Alvin F. Siewert, a widower, granting
to the City the following described real property situated
in the City of Anaheim, County of Orange, State of California:
That portion of the East 20 acres of the Northeast
quarter of the Northwest quarter of Section 28,
Township 4 South, Range 10 West, in the Rancho
Los Bolsas, as shown on a Map recorded in Book 51,
Page 10 of Miscellaneous Maps, records of Orange
County, California, described as follows:
Beginning at the Southeast corner of Tract No.
3240, as shown on a Map recorded in Book 113,
Pages 1, 2 and 3 of Miscellaneous Maps, records
of Orange County, California; thence North 0 55'30"
West 681.03 feet along the East line of said Tract
No. 3240; thence leaving the East line of said
Tract No. 3240, along a line bearing North
89 12' 43" East a distance of 661.44 feet to the
intersection with the East line of the Northeast
quarter of the Northwest quarter of said Section
28; thence South 0 55' 10" East 579.03 feet along
the East line of the Northeast quarter of the
Northwest quarter of said Section 28, to a point
distant 102.00 feet Northerly of the Southeast
corner of the Northeast quarter of the Northwest
quarter of said Section 28; thence South 89 12' 43"
West 116.00 feet; thence South 29 09' 35" West
117.72 feet to the intersection with the South
line of the Northeast quarter of the Northwest
quarter of said Section 28, said point of inter-
section being distant South 89 12' 43" West
175.00 feet from the East line of the Northeast
quarter of the Northwest quarter of said Section
28; thence South 89 12' 43" West 486.37 feet
along the South line of the Northeast quarter of
the Northwest quarter of said Section 28, to the
point of beginning.
EXCEPTING THEREFROM any portion thereof conveyed
to the Corporation of the Presiding Bishop of the
Church of Jesus Christ of the Latter Day Saints,
a corporation, by deed recorded October 6, 1961
in Book 5871, page 645 of Official Records of
Orange County, California,
be and the same is hereby accepted by the City Council of
the City of Anaheim.
BE IT FURTHER RESOLVED that the Easement Grant Deed
also this day submitted to the City Council by Alvin F.
Siewert, a widower, conveying to the City an easement for
public utility storm drain purposes over, under and across the
following described property situated in the City of Anaheim,
County of Orange, State of California:
An easement for public utility storm drain pur-
poses over, under and across that portion of the
East 20 acres of the Northeast quarter of the
Northwest quarter of Section 28, Township 4 South,
Range 10 West, S.B.B. M., described as follows:
Commencing at the Northeast corner of the East
20 acres of the Northeast quarter of the Northwest
quarter of said Section 28, said Northeast corner
being the center line intersection of Katella
Avenue with the center line of Ninth Street;
thence South 89 13' 30" West 611.50 feet along
the center line of Katella Avenue to an inter-
section with the Easterly line of that parcel of
land conveyed to the Orange County Flood Control
District by Document No. 97189, recorded July 24,
1957 in Official Records of Orange County
California; thence South 0 55' 30" East 40.00
feet along the Easterly line of the land conveyed
to said Orange County Flood Control District to
the true point of beginning of the parcel of land
hereinafter described; thence North 89 13' 30"
East a distance of 95.00 feet; thence South
71 52' 48" West 105 feet, more or less, to an
intersection with the East line of the land
conveyed to the aforementioned Orange County
Flood Control District, said point of intersection

be and the same is hereby accepted by the City Council of the
City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by
me this 9th day of April, 1963.
