63-0268RESOLUTION N0, 63R 268 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT A CHANGE OF ZONE SHOULD NOT BE GRANTED IN A CERTAIN AREA OF THE CITY HEREINAFTER DESCRIBED. WHEREAS, the City Planning Commission of the City of Anaheim has heretofore duly passed and adopted a resolution recommending denial of a change in the boundaries of the zone or zones hereinafter mentioned and described, after having fixed a time and place for the holding of a public hearing thereon in the manner and as prescribed in Title 15 of the Anaheim Municipal Code, and after having duly held and conducted such public hearing to consider said proposed change of zone or zones, and after having received evidence and reports from persons interested therein; and WHEREAS, within a period of forty (40) days following the hearing thereon, the Planning Commission did duly announce by formal resolution its findings of facts and declare its opinions and reasons for recommending denial of said proposed change in the boundaries of the zone or zones hereinafter mentioned and described; and WHEREAS, upon receipt of the report and recommendation of the City Planning Commission, the City Council did thereupon fix the 26th day of February 19 63 as the time and the Council Chamber in the City Hall of the City of Anaheim as the place for a public hear- ing upon said proposed change of zone or zones and did give notice there- of in the manner and as provided in said Title 18 of the Anaheim Muni- cipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did thereupon consider the recommenda- tions of the City Planning Commission; and WHEREAS, the City Council does find and determine that the property and area proposed to be changed from the zone or zones in which it is now situated to a different zone, as hereinafter set forth, is more suitable for the zone or zones in which it is now incorporated and that a change of zone should not be granted; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that all of the property and area situated in the City of Anaheim, County of Orange, State of California, described as follows: The West 180 feet of that portion of Lot 8 of Helen and Lynch's Subdivision of the West half of Section 16, in Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, as shown on a map thereof recorded in book 442, page 158, Deeds, records of Los Angeles County, California, lying South of the South line of Mabel Street, 60 feet in width; EXCEPTING THEREFROM the Northerly 100 feet thereof. -1- 62 -63 -61 remain in the M -1, LIGHT INDUSTRIAL and P -L, PARKING LANDSCAPING ZONES, in which it is now incorporated, and that the reclassifi- cation to C -3, HEAVY COMMERCIAL ZONE or C -1, NEIGHBORHOOD COMMERCIAL ZONE, be denied, as recommended by the City Planning Commission. WILLIAMS CITY CLERK OF THE CITY OF ANAHEIM By C ��lit���c�i' DEPUTY CITY CLERK RESOLUTION NO. 63R- 267 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AMENDING RESOLUTION NO. 5409 AND TERMINATING THE PROVISIONS OF RESOLUTION NO. 7301. WHEREAS, the City Council of the City of Anaheim by Resolution No. 5409 did establish rates for general water ser- vice and connections and did fix charges for the installation of water mains for water furnished consumers and for all ser- vices rendered in connection therewith; and WHEREAS, said Resolution No. 5409 was amended by Resolution No. 7301; and WHEREAS, the provisions of Resolution No. 7301 did establish different and special rates for different classes of consumers outside of the City of Anaheim; and WHEREAS, the City Council of the City of Anaheim does find that the rates so established by Resolution No. 7301 should be amended and changed to establish uniform rates for water users outside the City Limits of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Paragraph 7 of Resolution No. 5409 be amended to read as follows: "7. RATES OUTSIDE CITY LIMITS. Per Meter Rates Per Month Quantity Rates: First 750 cu. ft. or less 2.50 Next 3,000 cu. ft. per 100 cu. ft. .23 Next 7,000 cu. ft. per 100 cu. ft. .20 All over 10,750 cu. ft. per 100 cu. ft. .14 Mr. Ogden Geo Oelkers The rates applicable to all consumers of water from City -owned and maintained water mains outside the City Limits of the City of Anaheim shall be established by the City Council with relationship to rates established inside the City and shall not discriminate between services rendered outside the City Limits of the City of Anaheim and services rendered within said City Limits except insofar as such rates outside the City Limits may be adjusted and in- creased to offset any reasonable burden sustained by resi- dents and taxpayers within the City by contribution to the operation of a municipal water system. (a) Rates applicable to all areas served by the City outside of the City Limits of the City of Anaheim ex- cept areas served which are included within the City Limits of an unincorporated City which maintains a municipal water system. Such rates are hereby established as follows: (1) Metered Rates: Rates (Contd.) (2) Unmetered Rates: Monthly rates 6.50 No consumer shall be entitled to this rate, and such rates shall only apply until such time as the City of Anaheim shall have metered the particular service. (3) As to the Hillview Tract purchased from the Pacific Water Company, in order to carry out the in- tent of the rate set for such tract upon its acqui- sition, the rate for the Hillview Tract established by Resolution No. 7301 shall remain in full force and effect until the 1st day of February, 1964, and upon such date the foregoing rate established for outside water users where the system has been acquired from a private domestic water company shall prevail unless the said tract has been incorporated within the City Limits. "(b) Rates applicable to all consumers of water from City -owned and maintained water mains outside the City Limits of the City of Anaheim where said lines are within the in- corporated boundaries of a city owning and maintaining a domestic water system shall be established by resolution of the City Council at the same rates charged by said municipa- lity on their own domestic water system. In areas where the City of Anaheim furnishes water to residents of other cities where such city maintains its domestic water system, it is the intent of the City of Anaheim to furnish such services only as a courtesy to such city until such time as said city by the extension of its mains can acquire those facilities of the City of Anaheim and integrate them within their own system." BE IT FURTHER RESOLVED that Resolution No. 7301 shall be and become inoperative from and after the date of the adoption of this resolution except insofar as such Resolution No. 7301 governs the rates to be charged to the Hillview Tract and as to such provision shall become inoperative and of no further effect upon the 1st day of February, 1964. AND BE IT FURTHER RESOLVED that except as herein amended all other provisions of Resolution No. 5409 as amended by Resolution No. 7495 are to remain in full force and effect.
