63-0254RESOLUTION NO. 63R -254 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DETERMINING THE NECESSITY FOR, AND DIRECTING THE ACQUISITION BY EMINENT DOMAIN OF, REAL PROPERTY FOR PUBLIC LIBRARY PURPOSES. WHEREAS, public convenience and necessity require the construction, completion and operation of a public improvement within the City of Anaheim, to wit: A public library; and WHEREAS, the City Council does find and determine that public interest and necessity require the acquisition of all that certain real property herein described by the City of Anaheim for the construction and operation of a public library. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that public interest and necessity require the acquisition of that certain real property situated in the City of Anaheim, County of Orange, State of California, more particularly described as follows, to wit: That portion of the Northeast quarter of the Southwest quarter of Section 12, Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, as shown on a Map recorded in Book 51, page 10 of Miscellaneous Maps, records of Orange County, California, described as follows: Accountii',g Off, R/W Beginning at the Northwest corner of that parcel of land conveyed to Forest Lawn Cemetery Association, a California corporation, as Parcel Number One, in the deed recorded December 30, 1960, in Book 5570, pages 213 and 214 of Official Records of Orange County, California; thence South 78 52' 36" East along a portion of the North line of said land, a distance of 160.91 feet; thence South 0 10' 40" West a distance of 314.43 feet; thence North 89 49' 20" West a distance of 157.98 feet; thence North 0 10' 40" East 344.99 feet to the point of beginning. BE IT FURTHER RESOLVED that the City Council does hereby find and determine that public interest and necessity require the acquisition of said land by the City of Anaheim for the construction, completion and operation of the afore- said project, and that the taking of the property hereinabove described is necessary therefor, and that the use to which it is to be applied is a use authorized by law, and the taking of said property is necessary to such use. NOW, THEREFORE, IT IS HEREBY AUTHORIZED that said property be acquired by the City of Anaheim, and the City Attorney of the City of Anaheim is hereby directed to institute an action in eminent domain for the acquisition of the title to said property, and to perform and carry out all of the necessary proceedings and steps incident to the acquisition of the title to said property and to obtaining possession thereof. -1- THE FOREGOING RESOLUTION is approved and signed by me this 2nd day of April 19 63 ATTEST: DENE M.
