Dear City Clerk:
In accordance with the California Public Records Act , please research and provide to this office, the following for the incident that occurred
at the Incident Location on 12/22/2023 at approximately 5:30AM, involving Duane Craig Remsnyder, who was a pedestrian, and James
Michael Barnhill, who was operating a 2006 Kia Soul (hereinafter “Subject Incident”):

12/22/2023 – 12/23/2023;
2.Any and all as-built plans for subject intersection for the time period of 12/22/2013 to the present time;
3.Any and all traffic volume counts of the subject intersection for the time period of 12/22/2013 to the present time;
4.Any and all safety analysis and safety studies of the subject intersection for the time period of 12/22/2013 to the present time;
5.Any crossroads documentation and studies for the time period of 12/22/2013 to the present time;
6.Collision data for the subject intersection for the time period of 12/22/2013 to the present time;
7.And speed studies and gap studies for the time period of 12/22/2013 to the present time.
Please make sure that the City of Anaheim puts a litigation hold on any of the above evidence relating to this location or incident (and that
all emails are saved).
It is imperative that you take affirmative steps to preserve these items as the failure to do so may constitute negligent or intentional
spoliation of evidence in which case we would seek evidentiary, issue and/or terminating sanctions. Kindly advise us where these items are
located and to the extent that you are aware, the identity, address, and telephone number of any other party who may have in his
possession any evidence relating to the incident.
Please do NOT dispose of any of these documents and items as we will need them. We would be willing to pick them up and pay for them.
