A RESOLUTICN OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AUTHORIZING THE COMPROMISE OF
CERTAIN EMINENT DOMAIN LITIGATION.
WHEREAS, heretofore, by its Resolution No. 63R -151
the City of Anaheim authorized and directed the initiation of
condemnet:"cn proceedings which resulted in the commencement
of Orange County Superior Court Case No. 111149, being entitled
"City of Anaheim vs. Dyke Water Company, et al."; and.
WHEREAS, the defendants to said litigation have offered
to compromise the same and have proposed and offered. a Stipula-
tion of Facts and "s To Value setting the value of the water
system sought to be condemned at $1,891,245.00; and
WHEREAS, a copy of said Stipulation of Facts and As
To Value is attached hereto and made a part hereof; and
WHEREAS, the City Council of the City of Anaheim finds
that the sum of $1,891,245.00 is a fair and reasonable amount to
be paid for the property condemned.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the City Attorney be, and he is hereby
authorized to settle said litigation for the sum of $1,891,245.00
and to enter into said Stipulation of Facts and As To Value.
AND BE IT FURTHER RESOLVED that the Director of Finance
be, and he is hereby authorized and directed to deliver to the
City Attorney's Office the sum of $1,891,245.00 payable to Title
Insurance and Trust Company, Trustee, to be delivered by the
City Attorney to the Santa Ana Office of said Title Insurance and
Trust Company when Judgment has been entered in favor of the City
of Anaheim and against Dyke Water Company in the hereinabove des-
cribed action and when said City Attorney holds a Satisfaction of
Judgment in said action.
THE FOREGOING RESOLUTION is hereby approved and signed
by me this 26th day of March 1963.

AND I FURTHER CERTIFY that the Mayor of the City of
