63-0232WHEREAS, the City Council of the City of Anaheim is desirous of purchasing the hereinafter described real property for municipal purposes, to wit: An easement for road and public utility purposes and RESOLUTION NO. 63R -232 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ACCEPTING A GRANT DEED CONVEYING TO THE CITY OF ANAHEIM CERTAIN REAL PROPERTY FOR AN EASE- MENT FOR ROAD AND PUBLIC UTILITY PURPOSES. WHEREAS, the owners of said property have to sell and convey the same to the City; and WHEREAS, the City Council of the City of Anaheim finds that it is for the benefit and best interest of the City of Anaheim to accept said offer and purchase said real property. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the offer of JOSEPH WILLIAM HEINZ and CATHERINE HEINZ, husband and wife, offered to sell to the iI tyof Anaheim the following described real property situated in the City of Anaheim, County of Orange, State of California, to be used for an easement for road and public utility purposes and more particularly described as follows: An easement for road and public utility purposes over, under and across that portion of Lot 5 of the Miles Rancho, as shown on a Map recorded in Book 4, page 7 of Miscellaneous Maps, records of Orange County, Califor- nia, described as follows: Beginning at a point on the Westerly line of Lot 5, which is 369.66 feet Northerly of the Southwesterly cor- ner of said Lot 5; thence North 89 54' East along the Northerly line of the land conveyed to Arnold Construc- tion Company by deed recorded July 18, 1955 in Book 3142, page 230 of Official Records as Document Number 86560, a distance of 32.32 feet to the true point of beginning; thence North 89 54' East a distance of 12.68 feet; thence Northerly and parallel with the center line of Harbor Boulevard a distance of 3.50 feet to a point in the Southerly line of the land conveyed. to Mariam Littleton, et al., by decree recorded February 8, 1962 in Book 6003, page 182 of Official Records; thence Southwesterly along said Southerly line to the true point of beginning, a dis- tance of 13.16 feet, more or less. For the purpose of this description, the center line of said Harbor Boulevard is assumed to be the West line of said Lot 5; be, and the same is hereby, accepted by the City Council of the City of Anaheim, and that the City of Anaheim accept a convey- ance of said property. BE IT FURTHER RESOLVED that the City Auditor of the City of Anaheim be, and he is hereby, authorized to pay to the owner or owners of said real property, out of General Funds of the City of Anaheim, the sum of One Dollar ($1.00).
