63-0217A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceedings No. 62 -63 -75 to consider an amendment to Title o e £na eim 'un c pal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evi- dence, report of findings, and recommendation of the City Planning Commission the City Council did fix the 26th day of March 1963 as the time and the City Council Chambers in the City Hall of the City of Anaheim as the place for a Public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated, and the incorporation thereof in the zone or zones hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and RESOLUTION NO. 63R 217 WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing, and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: PORTION "A" That portion of the west half of the northeast quarter of the northeast quarter of Section 17, Township 4 South, Range 10 West, as per map recorded in Book 51, page 11, of Miscellaneous Maps, Records of the County of Orange, State of California, in the Rancho Los Coyotes, City of Anaheim, County of Orange, State of California, described as follows: 1 62 -63 -75 Beginning at a point in the northerly line of said west half distant easterly along said northerly line 315.00 feet from the northwesterly corner thereof; thence southerly parallel with the westerly line of said west half 352.00 feet to the true point of begin- ning; thence continuing southerly along said last mentioned line 341.00 feet; thence easterly parallel with the north line of said west half to the east line of said west half; thence north along said east line to the southerly line of the northerly 251.00 feet of said west half; thence westerly along said last mentioned southerly line to its intersection with the easterly line of the westerly 520.00 feet of said west half; thence southerly along said last mentioned easterly line to its intersection with the southerly line of the northerly 489.00 feet of said west half; thence westerly parallel with the northerly line of said west half to its intersection with the easterly line of the westerly 377.50 feet of said west half; thence northerly along said last mentioned easterly line to its intersection with the southerly line of the northerly 352.00 feet of said west half; thence westerly parallel with the northerly line of said west half 62.50 feet to the true point of beginning. PORTION "B" That portion of the west half of the northeast quarter of the northeast quarter of Section 17, Township 4 South, Range 10 West, as per map recorded in Book 51, page 11, of Miscellaneous Maps, Records of the County of Orange, State of California, in the Rancho Los Coyotes, City of Anaheim, County of Orange, State of California, described as follows: The southerly 185.00 feet of the northerly 251.00 feet of said west half, EXCEPTING THEREFROM the Westerly 520.00 feet; be excluded from R -A, RESIDENTIAL- AGRICULTURAL ZONE and incor- porated in the following zones, upon the conditions hereinafter set forth: That Portion "A" of the real property above shall be changed to and incorporated in the FAMILY RESIDENTIAL ZONE; and That Portion "B" of the real property above shall be changed to and incorporated in the HOOD COMMERCIAL ZONE. described R -3, MULTIPLE- described C-1, NEIGHBOR- That said change of zones shall be made upon the following conditions: 1. (a) That all engineering requirements of the City of Anaheim along Lincoln Avenue, including prepara- tion of improvement plans and installation of all improvements, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of said engineering requirements. 2. That the owners of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot, along Lincoln Avenue, for street lighting purposes. 3. That the owners of subject property shall deed to the City of Anaheim a 3 -foot public utility over- hang easement along the easterly, southerly and westerly boundaries of subject property. 4. That the owners of subject property shall pay to the City of Anaheim the sum of $25.00 per dwelling unit, to be used for park and recreation purposes, said amount to be paid at the time the building permit is issued. 5. That adequate areas for trash storage, accessible to trash -truck pickup, shall be provided as deter- mined and required by the Street Maintenance and Sanitation Division of the Public Works Department, which areas shall be enclosed by a solid fence or wall prior to final building inspection. 6. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department, said fire hydrants to be installed prior to final building inspection. 7. That the access drives shall be a minimum width of 21 feet, if adequate angle cut -offs are provided, or a minimum width of 28 feet if no cut -offs are provided, and said access drives shall, in all cases, have a minimum vertical clearance of 14 feet. 8. That all buildings constructed on the R -3 portion of subject property shall have shake roofs. 9. That a 6 -foot masonry wall shall be constructed along the south and east boundaries of subject pro- perty where said property abuts single- family resi- dential development; and that said wall shall be constructed prior to final building inspection. 10. That all drainage from the rear of subject property shall be directed away from the single family development; and that arrangements shall be made for the drainage of subject property, and such arrangements shall be subject to the approval of the City Engineer. 11. That the interior walls of the proposed carports shall be stuccoed; that enclosed storage cabinets shall be provided along the rear wall of each car- port; that adequate bumper guards shall be provided to protect the interior walls of the proposed car- ports; and that all of said items shall be completed prior to final building inspection. 12. That the owners of subject property shall place of record City of Anaheim C-1 Deed Restrictions covering the C -1 area, approved by the City Attorney, which restrictions shall limit the C -1 uses of the property to business and pro- fessional uses only. 13. That a 6 -foot landscaped strip shall be provided and maintained abutting the setback on the Lincoln Avenue frontage; that plans for said landscaping shall be submitted to and approved by the Superin- tendent of Parkway Maintenance; and that said land- scaping shall be installed prior to final building inspection. 14. That a 35 -foot building setback line shall be established from the planned highway right of way line of Lincoln Avenue. 15. That tree wells shall be installed at 40 -foot intervals in the parkway portion of the Lincoln Avenue frontage; that plans for said landscaping shall be submitted to and approved by the Super- intendent of Parkway Maintenance; and that said landscaping shall be installed prior to final building inspection. 16. That subject property shall be developed substan- tially in accordance with Exhibits Nos. 1, 2 and 3, as amended herein, on file with the City of Anaheim, such development in accordance with the aforementioned exhibits to be subject to the inspection of the Development Review Division of the Planning Depart- ment in order to insure development in conformity with said exhibits, as amended. 17. That the completion of these reclassification pro- ceedings is contingent upon the granting of Con- ditional Use Permit No. 373. 18. That Conditions Nos. 1(b), 2, 3, and 12 above mentioned shall be complied with within 180 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and deter- mined to be necessary and proper.
