63-0190RESOLUTION NO. 63R -190 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM OPPOSING ASSEMBLY BILL NO. 927. WHEREAS, Assembly Bill No. 927 would be legislative action preventing the use of the polygraph or lie detector in- strument by cities and other employers and excluding its appli- cation to the State and Federal Government and therefore without equal and consistent application; and WHEREAS, said polygraph instrument has been determined a most valuable and accurate technique of investigation serving courts, police investigating facilities, political subdivisions and in pre employment investigation as well as the investigation of incidents arising after employment; and WHEREAS, the use of said polygraph instrument is the most effective way of detecting characteristics and incidents in the background of a prospective employee which may be determina- tive factors affecting employment and thereby of significant con- cern to the public to be served by such prospective employee; and WHEREAS, said polygraph instrument enables the employer to substantiate the honesty of prospective employees as well as to reveal deception, and thereby facilitates the hiring of said prospective employees; and WHEREAS, such attempted legislative mandate would be an unwarranted invasion into home rule. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the enactment of Assembly Bill No. 927 be opposed for the above and foregoing reasons, and particularly because of the detrimental effect to the most desirable admini- stration of municipal affairs, and therefore to the interests of the public, and that the representatives of Orange County in the California Legislature be urged to oppose the enactment of this Bill, and any similar legislation that may be offered for enact- ment. AND BE IT FURTHER RESOLVED that a certified copy of this resolution be prepared and sent to the Honorable John A. Murdy, Jr., State Senator, and to the Honorable William E. Danneymeyer, the Honorable James E. Whetmore and the Honorable Robert E. Badham, State Assemblymen from Orange County.
