63-0179RESOLUTION NO, 63.I -179 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZONES SHOULD BE CHANGED, WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceedings No. 62 -63 -67 to consider an amendment to Title o t e *na eim 'un'cipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evi- dence, report of findings, and recommendation of the City Planning Commission the City Council did fix the 5th day of March 19 63 as the time and the City Ccuncil Chambers in the City Hall of t e City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is new situated, and the incorporation thereof in the zone or zones hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title i8 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Counc.1 did hold and conduct such public hearing, and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: That portion of the east 5 acres of the south half of the southeast quarter of the southwest quarter of section 13, in Township 4 South, Range 11 West, in the Rancho Los Coyotes, City of Anaheim, County of Orange, State of California, as said section is shown on a map recorded in Book 51, page 11 of Miscellaneous Maps, in the office of the County Recorder of said County, described as follows: -1- 62 -63 -67 Beginning at the southeast corner of said south half of the southeast quarter of the southwest quarter; thence North 0 09' 35" East 396.40 feet along the East line of said south half to the true point of beginning; thence South 89 58' 35" West 329.71 feet parallel with the north line of said east 5 acres to the west line of said. east 5 acres; thence South 0 09' 35" West 396.34 feet along said west line to the south- west corner of said east 5 acres; thence North 89 59' 15" East 329.71 feet along the south line of said east 5 acres to the southeast corner of said east 5 acres; thence North 0 09' 35" East 396.40 feet along the east line of said east 5 acres to the true point of beginning; be excluded from R-A, RESIDENTIAL-AGRICULTURAL ZONE, and incor- porated in the following zones, upon the conditions hereinafter set forth: That the north 193.34 feet of the above-described property shall be changed to R-3, MULTIPLE-FAMILY RESIDENTIAL ZONE; and That the remainder of said property shall be changed to C-1, NEIGHBORHOOD-COMMERCIAL ZONE, upon the following conditions: 1. That the owners of subject property shall deed to the City of Anaheim a strip of land 53 feet in width, from the center line of the street, along Ball Road for street widening purposes. 2. That the owners of subject property shall deed to the City of Anaheim a strip of land 45 feet in width, from the center line of the street, along Dale )'venue for street widening purposes. 3. (a) That all engineering requirements of the City of /snaheim along Ball Road and Dale Avenue, includ- ing preparation of improvement plans and installa- tion of all improvements, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be com- plied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and forth satisfactory to the City of tnaheim shall be posted with the City to guarantee the installation of said engineer- ing requirements. 4. That the owners of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot, along Ball Road and Dale venue, for street lighting purposes. 5. That the owners of subject property shall pay to the City of Anaheim the sum of $25.00 per dwelling unit, to be used for park and recreation purposes, said amount to be paid at the time the buildin,, permit is issued. 2 6. That adequate areas for trash storage, accessible to trash-trucz pickup, shall be provided as deter- mined and required by the Street Maintenance and Sanitation Division of the Public Works Department, which areas shall be enclosed by a solid fence or wall prior to final building inspection. 7. That a modified cul-de-sac shall be provided at the terminus of Elmlawn Drive, and that said cul-de-sac shall be subject to the approval of the City Engineer. 8. That drainage facilities shall be installed. for Ball Road and Dale /venue, as required by the City Engineer and in accordance with standard plans on file in the Office of the City Engineer. 9. That the owners of subject property shall deed to the City of Anaheim and improve, for alley purposes, a strip of land 20-feet in width, as indicated on Exhibit "LA," Revision No. 1, on file with the City of inaheim, and as required in Condition No. 10 hereof, said alley to be improved to City standards as required by the City Engineer and in accordance with plans and specifications on file in the Office of the City En,ineer. 10. That subject property shall be developed substan- tLally in accordance with Exhibit Revision No. 1, approved by the City Council and signed and dated by Mayor Coons on March 5, 1963, and in accordance with Exhibit No. 2, said exhibits beinc, on file with the City. 11. That a 6-foot masonry wall shall be constructed along the southerly boundary of the alley along the northerly edge of the C-1, Neighborhood-Commercial, Zone property; and that said well shall be con- structed prior to final building inspection. 12. That a 6-foot masonry wall shall be constructed along the westerly boundary of subject property (both the R-3 and. C-1 portions); and that said wall shall be constructed prior to final building in- spection. 13. That tree wells shall be installed at 40-foot inter- vals in the parkway portion of the Dale Avenue and Ball Road frontages, prior to final building inspec- tion, and that plans for said landscaping shall be submitted to and approved by the Superintendent of Parkway Maintenance. 14. That a strip of land of a minimum width of 6 feet shall be landscaped and maintained separating the C-1, Neighborhood-Commercial Zone property from the proposed service station to be located on the easterly portion of the C-1 property, said land- scaping to be installed prior to final building inspection. 3 15. That the completion of these reclassification proceedings is contingent upon the granting of Conditional Use Permit No. 363. 16. That Conditions Nos. 1, 2, 3(b), 4, 7, 3 and 9 above-mentioned shall be complied with within a period of 130 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and deter- mined to be necessary and proper.
