63-0648RESOLUTION NO. 63R -648 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Pro- ceedings No. 62 -63 -130 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings, and recommendation of the City Planning Commission the City Council did fix the 30th day of July 1963 as the time and the City Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said prop- erty, hereinafter described, from the zone or zones in which it is now situated, and the incorporation thereof in the zone or zones hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing, and did give all persons interested therein an oppor- tunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: 62 -63 -130 That portion of Lot 7 of Anaheim Extension, in the City of Anaheim, County of Orange, State of California, according to a map of Survey made by Wm. Hamel, acknowledged by Alfred Robinson, Trustee, and on file in the office of the County Recorder of Los Angeles County, California, described as follows: Beginning at the intersection of the center lines of Sycamore Street and Placentia Avenue, and running thence South 74 29' 35" West along said center line of Sycamore Street 181.15 feet; thence South 0 07' 25" West parallel with said center line of Placentia Avenue 135.70 feet; thence North 74 29' 35" East parallel with said center line of Sycamore Street 181.15 feet to said center line of Placentia Avenue; thence North 0 07' 25" East along said center line of Placentia Avenue 135.70 feet to the point of beginning. be excluded from R -A, RESIDENTIAL- AGRICULTURAL ZONE, and incor- porated in C -1, NEIGHBORHOOD COMMERCIAL ZONE, upon the following conditions: 1. That the owners of subject property shall deed to the City of Anaheim a strip of land 32 feet in width, from the center line of the street, along Sycamore Street, for street widening purposes. 2. (a) That all engineering requirements of the City of Anaheim along Sycamore Street, including preparation of improvement plans and installation of all improvements, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and speci- fications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of said engineering requirements. 3. That sidewalks and driveways shall be constructed along State College Boulevard as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer. 4. That the owners of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot, along Sycamore Street and State College Boulevard, for street lighting purposes. 5. That trash storage areas shall be provided in accordance with standard plans on file in the Office of the Director of Public Works and Superintendent of Streets, prior to final building inspection. 6. That the owners of subject property shall pay to the City of Anaheim the cost of installation of the curb and gutter along State College Boulevard. 7. That subject property shall be developed substan- tially in accordance with plans on file with the City of Anaheim, marked "Exhibits Nos. 1 and 2, Revision No. 1," as amended herein. 8. That a strip of land of a minimum width of six feet shall be landscaped and said land- scaping maintained adjacent to State College Boulevard and Sycamore Street rights of way abutting subject property, except for access drives; that plans for said landscaping and all landscaping visible from State College Boulevard and Sycamore Street shall be submitted to and approved by the Superintendent of Parkway Maintenance; and that said landscaping shall be installed prior to final building inspection. 9. That signs, flags, banners and displays visible from State College Boulevard and Sycamore Street shall be limited to one unlighted sign of a maximum size of eight square feet. 10. That a 6 -foot masonry wall shall be constructed along the west and south boundaries of subject property, where such wall does not exist, and that said wall shall be constructed prior to final building inspection, or that a bond in an amount and form satisfactory to the City of Anaheim may be posted with the City to guarantee the construction of said wall along the south boundary of subject property. 11. That any alteration of the existing structure on subject property, including the installation of any air conditioning facilities, shall be subject to approval of the Development Review Board; provided, however, that no air conditioning facilities shall be placed on the roof of the existing structure. 12. That tree wells shall be provided at approximately 40 -foot intervals in the Sycamore Street and State College Boulevard parkways abutting subject property; that plans for said tree wells and the landscaping therein shall be submitted to and approved by the Superintendent of Parkway Maintenance; and that said tree wells shall be planted prior to final building inspection. 13. That Conditions Nos. 1, 2, 3, 4 and 6 above mentioned shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and de- termined to be necessary and proper.
