A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM APPROVING AND AUTHORIZING THE EXECUTION
OF AN AGREEMENT BETWEEN THE CITY OF ANAHEIM AND
THE CITY OF GARDEN GROVE WITH REFERENCE TO THE
MODIFICATION OF THE TRAFFIC SIGNAL AT CHAPMAN
AVENUE AND HARBOR BOULEVARD.

WHEREAS, considerable traffic congestion presently
exists and is progressively increasing at the intersection of
Chapman Avenue and Harbor Boulevard, a portion of which inter-
section is in the City of Anaheim and a portion of which is in
the City of Garden Grove; and
WHEREAS, a study has been completed and the conclusion
drawn that traffic conditions at said intersection warrant the
modification of the existing traffic signal and highway intersec-
tion lighting for the proper and orderly movement of traffic by
the addition of left turn protection to the existing traffic
signal system, and associated road work; and
WHEREAS, the City of Anaheim is willing to cooperate
with Garden Grove in the modification of the traffic signal and
intersection lighting system, and is willing to contribute to
the maintenance of said system subsequent to its installation; and
WHEREAS, said Cities of Anaheim and Garden Grove desire
to enter into an agreement to provide for the modification and
maintenance of said traffic signal and to specify the proportion-
ate share of the costs that are to be borne by each of said Cities.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the agreement this day submitted to the
City Council to be made and entered into by and between the City
of Anaheim and the City of Garden Grove, providing for the modifi-
cation and maintenance of the existing traffic signal and highway
lighting at the intersection of Chapman Avenue and Harbor Boule-
vard, upon the terms and conditions hereinafter set forth, and
specifying the proportionate share of the costs to be borne by
each of said Cities, be and the same is hereby approved. That
the terms and conditions of said agreement are as follows:
1. The City of Garden Grove shall:
A. Prepare the detailed plans, specifications and estimate
for the project.
B. Prepare map and deed for all necessary additional right
of way.
C. Have jurisdiction of the construction area within the
Cities of Anaheim and Garden Grove.
D. Be designated as the contracting and construction agent
for the parties to do and perform all acts and things
necessary or required in order to construct the project
in accordance with the plans and specifications, includ-
ing material control, inspection of the construction
work, and to execute and deliver all documents necessary
or required in connection with the construction and com-
pletion of said project, including certificate of day
labor, equipment and material costs, and certification
of completion of the project.
2. The City of Anaheim shall:
A. Approve plans and specifications as to design and
construction features affecting the construction
operation and maintenance of the portion of the
project within the City of Anaheim.
B. Approve map and deed of right of way and make all
the necessary arrangements to acquire the right
of way for its portion of the project and shall,
by appropriate resolution of the City Council so
certify to the City of Garden Grove, prior to the
Garden Grove City Council approving the project
plans and specifications, that such acquisition
has been accomplished.
C. At all times during the progress of construction
of the project have access to the work for the
purpose of inspection thereof and should the City
of Anaheim deem any remedial measures to be
necessary, it shall notify the City of Garden Grove
thereof.
3. Upon completion of the project, any and all road work
necessary in connection with said project shall be paid
for by the respective parties on the basis of the actual
work done within the limits of their respective juris-
dictions.
4. Upon completion of said project, the City of Anaheim's
share of the traffic signal and intersection lighting
system modification will be determined in the same ratio
to the total cost of such system as the number of legs
under the City of Anaheim's jurisdiction entering the
intersection are to the total number of legs entering
the intersection.
5. For the purpose of determining the proportionate share
of the project costs to be borne by the respective par-
ties hereto the City limits of Anaheim and the number of
legs entering the intersection under the jurisdiction of
the City of Anaheim shall be established as those existing
at the time the Garden Grove City Council adopts the reso-
lution approving the project plans and specifications for
advertising for bids.
6. Upon completion of the project, the City of Garden Grove
shall submit full, true and correct copies of documents,
certificates and itemized bills to the City of Anaheim,
and the City of Anaheim shall reimburse the City of Garden
Grove within 30 days upon submission of statement of such
costs for the full cost of the construction as defined in
paragraphs numbered 3 and 4 hereof.
7. All construction and installation costs shall be based on
the contract unit cost.
8. The City of Anaheim's share of the design, survey and con-
struction engineering costs shall be 10% of the City of
Anaheim's proportionate share of the construction and
installation contract costs.

9. After the completion of the project, the traffic
signals shall be maintained by the City of Garden
Grove and the City of Anaheim shall pay to the City
of Garden Grove upon submission of said costs, the
maintenance and energy costs in the same ratio to
the total cost as the number of legs under the City
of Anaheim's jurisdiction entering the intersection
are to the total number of legs entering the inter-
section.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
be and they are hereby authorized to execute said agreement for
and on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by me
this 30th day of July 1963.
