63-0630RESOLUTION NO. 63R -630 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ACCEPTING A SEALED PROPOSAL AND AWARDING A CONTRACT TO THE LOWEST RESPONSIBLE BIDDER WHOSE BID BEST RESPONDS IN QUALITY, FITNESS AND CAPACITY, FOR ALL LEGAL ADVERTISING REQUIRED BY LAW TO BE PUBLISHED IN A NEWSPAPER OF GENERAL CIRCULATION, PRINTED AND PUBLISHED WITHIN THE CITY. WHEREAS, the City Council of the City of Anaheim did cause to be published in a newspaper of general circulation, printed, published and circulated in the City of Anaheim, to wit: Anaheim Bulletin, on the 13th and 19th days of July, 1963, a notice inviting sealed proposals for furnishing the following legal advertising: For all legal advertising to be done by the City of Anaheim, required by law to be published in a newspaper of general circulation printed and published within said City, for the year commencing August 1, 1963 and ending July 31, 1964, in conformity with the specifications for such advertising, which specifications are marked and designated Specifications for Printing and Advertising of the City of Anaheim, Series of 1959," on file in the office of the City Clerk of the City of Anaheim. AND WHEREAS, said notice inviting sealed proposals for said legal advertising did provide that sealed proposals would be received by the City of Anaheim at the office of the City Clerk of the City of Anaheim up to the hour of 3:00 o'clock P. M., on the 23rd day of July, 1963, for the furnishing of all legal advertising to be done by the City, required by law to be published in a newspaper of general circulation, printed and published within the City of Anaheim, for the year commencing August 1, 1963 and ending July 31, 1964; and WHEREAS, the City Clerk of the City of Anaheim did receive the following sealed proposals prior to 3:00 o'clock P. M. on the 23rd day of July, 1963, in response to the notice afore- said inviting sealed proposals, to wit: NAME Anaheim Gazette Newspaper "Anaheim Gazette" OD Mt Anaheim Bulletin Publishing Company "The Bulletin" PRICE $.95 per column inch for first insertion $.85 per column inch for each insertion thereafter. $1.25 per column inch for the first insertion $1.00 per column inch for each subsequent insertion. AND WHEREAS, the City Council finds that the sealed proposal submitted by The Bulletin, 232 South Lemon Street, i Anaheim, California, is the lowest responsible proposal that best responds in quality, fitness and capacity for the publica- tion of all legal advertising of the City of Anaheim required to be published in a newspaper of general circulation, printed and published inside the City, because of the fact that the only other bid submitted was the bid of the Anaheim Gazette, said newspaper qualifying as a newspaper of general circulation, but, in accordance with the information furnished by each bidder, it was revealed that the Anaheim Gazette had a paid circulation of approximately 1,500, with a total circulation of 10,400, as compared to the paid circulation of The Bulletin of 19,079, and the City Council finds that in order to serve the spirit of the legal publication requirements of the applicable statutes re- quiring legal publications, such publications should be directed to the widest circulation of its citizens; and the Council further finds that paid subscribers to a newspaper are more likely to read said newspaper than the unpaid gratuitous receivers of said newspaper. The Council further finds that the increased paid circulation of The Bulletin greatly outweighs the additional costs of publication as submitted by The Bulletin. The City Council further finds that said bid of The Bulletin conforms with the specifications for said advertising on file in the office of the City Clerk of the City of Anaheim, as specified in the notice inviting sealed proposals; and that the person, firm or corporation submitting said proposal is a responsible person, firm or corporation, and that the proposal of said above named bidder should be accepted and a contract awarded to said bidder in accordance therewith. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the sealed proposal submitted by The Bulletin, 232 South Lemon Street, Anaheim, California, for the furnishing of all legal advertising to be done by the City, re- quired by law to be published in a newspaper of general circula- tion, printed and published within the City of Anaheim, for the year commencing August 1, 1963, and ending July 31, 1964, in conformity with the specifications on file in the office of the City Clerk of the City of Anaheim and the notice inviting sealed proposals be, and the same is hereby accepted, and that a contract for said legal advertising be, and the same is hereby, awarded to the said above named bidder.
