63-0558RESOLUTION NO. 63R -558 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Pro- ceedings No. 62 -63 -120 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings, and recommendation of the City Planning Commission the City Council did fix the 25th day of June 19 63 as the time and the City Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said prop- erty, hereinafter described, from the zone or zones in which it is now situated, and the incorporation thereof in the zone or zones hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing, and did give all persons interested therein an oppor- tunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: -1- 62 -63 -120 The West 264 feet of the East 661 feet of the North half of the Northwest quarter of the Northeast quarter of Section 24, Township 4 South, Range 11 West, in the Rancho Los Coyotes, as shown on a map recorded in Book 51, page 11 of Miscellaneous Maps, records of Orange County, California. be excluded from R -A, RESIDENTIAL AGRICULTURAL ZONE, and incor- porated in R -3, MULTIPLE FAMILY RESIDENTIAL ZONE, upon the following conditions: 1. That the owners of subject property shall deed to the City of Anaheim a strip of land 53 feet in width, from the center line of the street, along Ball Road for street widening purposes. 2. (a) That all engineering requirements of the City of Anaheim along Ball Road, including preparation of improvement plans and installation of all improvements, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of said engineering requirements. 3. That the owners of subject property shall pay to the City of Anaheim the sum of per front foot, along Ball Road, for street lighting purposes. 4. That a modified cul -de -sac shall be provided at the terminus of MacDuff Street, which cul -de -sac shall be subject to approval of the City of Stanton. 5. That the owners of subject property shall deed to the City of Anaheim a strip of land 43 feet in width along the easterly boundary of subject property for street purposes, and shall also deliver to the City an irrevocable offer of dedication of a one -foot strip of land abutting said 43 foot strip on the east, said irrevocable offer of dedication to be conditioned upon the development of the abutting property to the east and the payment by such property owner of the cost of the development of the easterly 13 feet of said dedicated and improved right of way, and further conditioned upon the dedication and improvement of an additional 16 feet for an ultimate 60 foot right of way by the owner of the abutting property to the east. That said proposed street shall terminate in a cul -de -sac at the southern terminus with a minimum radius of 27 feet. -2- 6. (a) That all engineering requirements of the City of Anaheim along said proposed street, including preparation of improvement plans and installation of all improvements, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work, shall be complied with as required by the City Engineer and in accordance with standard plans and speci- fications on file in the Office of the City Engineer; provided, however, that a temporary asphalt berm shall be installed along the easterly one -foot strip offered for dedication to the City of Anaheim; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of said engineering requirements. 7. That the owners of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot along said proposed street for street lighting purposes, or shall install street lights along said proposed street in accordance with a street lighting plan approved by the Utilities Director. 8. That subject property shall be developed sub- stantially in accordance with Exhibits Nos. 1, 2, and 3, Revision No. 1, on file with the City of Anaheim; provided, however, that the four dwelling unit immediately to the west of the recreation area shall be deleted, and that the three dwelling units to the north and south of the recreation area shall be increased to four dwelling units. 9. That the completion of these reclassification proceedings is contingent upon the granting of Conditional Use Permit No. 426. 10. That Conditions Nos. 1, 2(b), 3,4, 5, 6(b) and 7 above mentioned shall be complied with w ithin a period of 180 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper.
