63-0548RESOLUTION NO. 63R -548 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO. 415 WHEREAS, the City Planning Commission of the City of Anaheim did receive an application from DAVID S. COLLINS, 1077 West Ball Road, Anaheim, California, for a Conditional Use Permit to establish an automobile and truck body repair and paint shop on the following described property situated in the City of Anaheim, County of Orange, State of California, to wit: That portion of Lot 8 of Helen and Lynch's Subdivision of the West half of Section 16, in Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, City of Anaheim, as shown on a map thereof recorded in book 442, page 158, Deeds, in the office of the County Recorder of Los Angeles County, California, described as follows: Beginning at the Southwest corner of the land des- cribed in the deed to Fred L. Stern and wife, recorded January 30, 1963, in book 6413, page 293, Official Records of said Orange County, said point being in the center line of Broadway Street, as conveyed to the County of Orange, said Southwest corner being distant along said center line 260.17 feet, more or less, East from the Southwest corner of said Lot 8, running thence West along said center line 80.17 feet more or less, to a point 180.00 feet from the Southwest corner of said Lot 8; thence North parallel to the West line of said Lot 8 to the intersection with a line which is parallel with and distant 110 feet South from the South line of Mabel Street, 60 feet in width; thence Easterly along said parallel line 80.17 feet, more or less to the Northwest corner of said land of Stern; thence South along the West line of said land of Stern to the point of beginning. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said application on May 13, 19 6 3 T notices of which said public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, in- vestigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing did adopt its Resolution No. 752, Series 196 63 granting Conditional Use Permit No. 415, subject to the conditions therein set forth and WHEREAS, thereafter, within twenty -two (22) days from the date of the adoption of said resolution, a written appeal was filed with the City Council protesting the action of the City Planning Commission in rarantiinn said Conditional Use Permit and said appeal was set for public hearing on June 25 1963 at the City Hall, in the City of Anaheim, and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council finds, after careful consideration of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing, that: 1. The proposed use is properly one for which a Conditional Use Permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not adversely affect the adjoining land uses and the growth and develop- ment of the area in which it is proposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare. 4. The traffic generated by the proposed use will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. 5. The granting of the Conditional Use Permit under the conditions imposed will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commis- sion granting said Conditional Use Permit be, and the same is hereby sustained and that Conditional Use Permit No. 415 be, and the same is hereby, granted permitting the establishment of an automobile and truck body repair and paint shop on the property hereinbefore described, subject to the following conditions: 1. That the owner of subject property shall deed to the City of Anaheim a strip of land 45 feet in width, from the center line of the street, along Broadway for street widening purposes. -2- 2. (a) That all engineering requirements of the City of Anaheim along Broadway, including preparation of improvement plans and installation of all improvements, such as curbs and gutters, side- walks, street grading and paving, drainage facilities, or other appurtenant work shall be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer; and (b) that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of said engineering requirements. 3. That the owner of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot, along Broadway, for street lighting purposes. 4. That adequate areas for trash storage, accessible to trash -truck pickup, shall be provided as deter- mined and required by the Street Maintenance and Sanitation Division of the Public Works Department, which areas shall be enclosed by a solid fence or wall prior to final building inspection. 5. That subject property shall be developed substan- tially in accordance with plans on file with the City of Anaheim, marked "Exhibit No. 1, Revision No. 1." 6. That the proposed use of subject property shall conform to and comply with all requirements of the M -1, Light Industrial Zone. 7. That a six -foot block wall shall be constructed along the westerly boundary of subject property, commencing at the northwest corner of the building and continuing northerly to the north property line of subject property, said wall to be constructed prior to final building inspection. 8. That Conditions Nos. 1, 2(b) and 3 above mentioned shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. The City Council hereby reserves the right to revoke such Conditonal Use Permit for good cause or failure of said owner, his heirs, successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein.
