63-0431RESOLUTION NO. 63R- 431 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM EMPLOYING ANAHEIM POST NO. 72 AMERICAN LEGION TO PLACE AND DISPLAY THE FLAG OF THE UNITED STATES IN CERTAIN PUBLIC PLACES IN THE CITY OF ANAHEIM; AND AUTHORIZING THE MAYOR AND THE CITY CLERK TO ENTER INTO A CONTRACT WITH SAID ANAHEIM POST NO. 72 AMERICAN LEGION FOR AND ON BEHALF OF THE CITY OF ANAHEIM. WHEREAS, the City Council finds that it will promote patriotism to display the flag of the United States in certain public places in the City of Anaheim on certain holidays herein- after enumerated; and WHEREAS, Anaheim Post No. 72 American Legion, a corpo- ration,has the facilities and is desirous of placing and displaying such flags at such times and places as hereinafter designated; and WHEREAS, the City Council does further find that it would be to the advantage and for the best interest of the City of Anaheim to employ said Anaheim Post No. 72 American Legion to render such service. Works NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Anaheim Post No. 72 American Legion, a corporation, be, and it is hereby, employed to set up and dis- play the flag of the United States at the places designated by the City Council at the times hereinafter set forth, and upon the following terms and conditions: 1. That for a period of five years, commencing with Labor Day, September 3, 1962, Anaheim Post No. 72 American Legion shall, upon the days hereinafter set forth, place in position 86 flags in the City of Anaheim at such places as the City Council shall direct. That said number of flags so to be placed may be increased or decreased by mutual consent of the City and said Anaheim Post No. 72 American Legion. 2. Such flags shall be set up and put in position on Lincoln's Birthday, Washington's Birthday, Memorial Day, Flag Day, Independence Day, Labor Day and Armistice or Veterans Day of each year during said five -year period. In the event that any of the above mentioned days shall fall upon a Sunday, such flags shall be set up and placed in position on the following day, unless the City Council shall direct to the contrary. Said flags shall be set up and placed in position on each of said days during said term not later than 7:00 o'clock A.M. and shall be taken down at sunset of the same day. 3. A11 flags damaged beyond repair or lost through negligence of Anaheim Post No. 72 American Legion, its officers, employees or agents, shall be replaced by said Post No. 72, or, if reparable, shall be repaired. 4. That Anaheim Post No. 72 American Legion shall be paid for such services the sum of $1.00 per flag, per year for said five -year period, which consideration shall be paid yearly at the first regular meeting of the City Council following Labor Day of each year, commencing Labor Day in 1962. BE IT FURTHER RESOLVED that the Mayor and the City Clerk be and they are hereby authorized and directed, for and on behalf of the City of Anaheim, to enter into a written contract with Anaheim Post No. 72 American Legion, as of the 3rd day of September, 1962, upon the terms and conditions herein set forth.
