63-0856RESOLUTION NO. 63R- 856 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING THE GRANTING OF A LICENSE TO MELODYLAND, A LIMITED PARTNERSHIP, TO ENCROACH UPON AN EASEMENT OF THE CITY FOR THE CONSTRUCTION AND ERECTION OF A DIRECTIONAL SIGN; AND AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE SAID LICENSE ON BEHALF OF THE CITY. WHEREAS, Melodyland, a limited partnership, is the operator of a theater known as Melodyland, located approximately two blocks east of Harbor Boulevard on Freedman Way; and WHEREAS, Freedman Way is a dedicated street, dedicated for street purposes bythe owner of the property upon which Melodyland is located; and WHEREAS, said partnership has, at its own cost and expense, obtained additional right of way and is, at its own cost and expense, improving said right of way for the purpose of re- lieving traffic at the intersection of Freedman Way and Harbor Boulevard by the installation of a right turn lane from Freedman Way into Harbor Boulevard; and WHEREAS, the operation of Melodyland creates unusual traffic problems when Melodyland is in operation and it is deemed necessary to have a directional sign directing persons from Harbor Boulevard along Freedman Way to Melodyland; and WHEREAS, with the creation of the right turn lane from Freedman Way into Harbor Boulevard, a portion of the existing right of way to Freedman Way will not be used for pedestrians nor vehicular traffic but will constitute a portion of a divider island separating the normal travelway from the right turn lane; and WHEREAS, the owner of the fee property under the ease- ment of Freedman Way being the owner of Melodyland is desirous of having a directional sign erected at the intersection of Harbor Boulevard and Freedman Way; and WHEREAS, said partnership wishes a permit to construct a large directional sign at the intersection of Freedman Way and Harbor Boulevard in the area of the easement for street purposes which will be contained in the divider island; and WHEREAS, the City Council of the City of Anaheim finds and determines that the issuance of an encroachment permit for the purpose of a directional sign to direct traffic from Harbor Boulevard along Freedman Way to Melodyland will be in the best interests of the CITY and the citizens of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that a license be granted by the City of Anaheim to Melodyland, a limited partnership, to enter upon and use the right of way easement of the City for the construction and erection of a directional sign thereon on that portion of said easement described in an agreement, entitled "License to Encroach upon Easement," dated October 29, 1963, and this day submitted to the City Council to be entered into by the City and said Melodyland; -1- and that said license be granted upon the terms and conditions set forth in said License to Encroach upon Easement. BE IT FURTHER RESOLVED that the Mayor and City Clerk be and they are hereby authorized to execute said license agree- ment for and on behalf of the City of Anaheim.
