63-0841RESOLUTION NO, 63R -841 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO, 472 WHEREAS, the City Planning Commission of the City of Anaheim did receive an application for a Conditional Use Permit from The Owen Company, 621 South Hope Street, Los Angeles 17, California, to establish a new and used automobile agency, in- cluding all servicing incidental thereto, on the following described property situated in the City of Anaheim, County of Orange, State of California, to wit: Those portions of Lots 3 and 4 of Tract No. 3351, in the City of Anaheim, County of Orange, State of California, as per map recorded in Book 110, pages 5, 6 and 7 of Miscellaneous Maps, in the office of the county recorder of said county, together with those portions of Sections 22 and 23 in Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, in the City of Anaheim, County of Orange, State of California, as per map recorded in Book 51, page 10 of said Miscellaneous Maps, described as a whole as follows: Beginning at a point on the easterly line of said lot 4, North 15 28' 50" West 50.00 feet from the southeast corner of said lot 4; thence South 74 31' 10" 328,30 feet West parallel with the southeasterly line of said lot 4 to the easterly line of Los Angeles Street (103.00 feet wide); thence North 17° 22' 55" West 280.00 feet along said easterly line and along the westerly lines of said lots 3 and 4; thence North 74 31' 10" East 337.59 feet parallel with the southerly line of said lot 3, to the easterly line of said lot 3; thence South 15 28' 50" East 279.85 feet to the point of beginning. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said application on September 4 19 63 notices of which said public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, inves- tigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing did adopt its Resolution No. 895 Series 1963 -64 granting Conditional Use Permit No. 472, subject to certain conditions set forth therein and WHEREAS, thereafter, within twenty-two (22) days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action of the City Planning Commission in grantin said Conditional Use Permit and did thereupon fix the 29th day of October 1963 as the time and the Council Chamber in the City Hall of the City of Anaheim as the place for a public hearing upon said Conditional Use Permit, and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and -1- WHEREAS, at the time and place fixed for s:id public hearing, the City Council did duly hold and conduct such hear- ing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; .nd WHEREAS, the City Council finds, after careful con sideration of the recommendations of the City P1,nning Commis- sion and all evidence and reports offered at said hearing, that: 1. The proposed use is properly one for which a Conditional Use Permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare. 4. The traffic generated by the proposed use will not impose an undue burden upon the streets and high- ways designed and improved to carry the traffic in the area. 5. The granting of the Conditional Use Permit under the conditions imposed will not be detrimental to the peace, health, s and general welfare of the citizens of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City P1 nning Com- mission granting said Conditional Use Permit be, and the same is hereby sustained and that Conditional Use Permit No. 472 be, and the same is hereby, granted permitting the establishment of a new and used automobile agency, in- cluding all servicing incidental thereto, on the property hereinbefore described, subject to the following conditions: 1. That sidewalks shall be installed along Los Angeles Street as required by the City Engineer and in accordance with standard plans and speci- fications on file in the Office of the City Engineer, prior to final building inspection. 2. That trash storage areas shall be provided in accordance with approved plans on file in the Office of the Director of Public Works and Superintendent of Streets, prior to final building inspection. 3. That subject property shall be developed substan- tially in accordance with plans on file with the City of Anaheim marked "Exhibits Nos. 1, 2, 3, 4, 5 and 6, Revision No. 1." 4. That the development and maintenance of subject property shall also be in conformance with all requirements of M -1, Light Industrial and P -L, Parking Landscaping Zones. 5. That tree wells shall be provided at approxi- mately 40 -foot intervals in the Los Angeles Street parkway abutting subject property; that plans for said tree wells and the plantings therein shall be submitted to and approved by the Superintendent of Parkway Maintenance; and that said tree wells shall be planted with trees prior to final building inspection. The City Council hereby reserves the right to revoke such Conditional Use Permit for good cause or failure of said owner, its successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein.
