A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM APPROVING AND AUTHORIZING
THE EXECUTION OF AN AGREEMENT WITH THE
STATE OF CALIFORNIA, DEPARTMENT OF PUBLIC
WORKS, DIVISION OF HIGHWAYS, WITH REFER-
ENCE TO THE MODIFICATION OF TRAFFIC SIG-
NALS AT CERTAIN INTERSECTIONS ON LOS
ANGELES STREET BETWEEN BALL ROAD AND
LEMON STREET.
WHEREAS, the State of California and the City of Anaheim
contemplate modification of the existing traffic control signal
systems at the intersections of Bali Road, Vermont Avenue, South
Street, Santa Ana Street, Center Street, Cypress Street, Sycamore
Street and North Street and modification of existing traffic con-
trol systems and installation of safety lighting at the inter-
sections of Broadway, La Palma Avenue and Lemon Street with State
Highway Route VII -Ora -2 -Ana (Los Angeles Street), all within the
City of Anaheim, and desire to specify the proportionate share of
the costs that are to be borne by the City and the State and to
arrange for maintenance; and
WHEREAS, the State of California, Department of Public
Works, Division of Highways, has tendered to the City an agree-
ment, entitled "Agreement No. 1519," to be executed by the City
and the State, setting forth the covenants and conditions to be
kept and performed by the City and the State and the estimated
amount of the Cityts share of said modification costs; and
WHEREAS, the City Council finds the terms and conditions
of said agreement to be fair and reasonable and that said agree-
ment should be approved.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that Agreement No. 1519, tendered to the City
by the State of California, Department of Public Works, Division
of Highways, to be entered into by the City and the State, and
providing for the modification of the existing traffic control
signal systems at the intersections hereinbefore mentioned, upon
the following terms and conditions:
State agrees;
(a) To modify the traffic control signal systems and in-
stall safety lighting hereinbefore mentioned, through
construction by contracts with construction con-
tractors licensed by the State of California, said
contract to be carried out in accordance with pro-
visions of the State Contract Act, Chapter 3, Part 5,
Division 3, Title 2 of the Government Code, and to be
completed in conformity with plans and specifications
of the State of California, Department of Public
Works, Division of Highways.

(b) To bear the entire expense of preparation of plans and
specifications, and Statets share of expense of the
construction engineering costs, including assessments for
indirect charges to be made at current rates, and con-
struction costs required to modify the traffic con-
trol signal systems and install safety lighting re-
ferred to herein, such share to be a sum bearing
the same proportion to the total cost of modifi-
cation of the traffic control signal systems and
installation of safety lighting as the number of legs
of highways under jurisdiction of the State at the
intersections involved, bears to the total number of
legs of highways at such intersections.
(c) To reimburse the City for the State's proportionate
share of the cost of general maintenance and oper-
ation of said safety lighting in the manner provided
in that Agreement for Maintenance of State highways
in the City which is in effect at the time said costs
arise.
(d) State will maintain and operate the entire traffic
control signal systems as constructed.
City agrees:
(a) To reimburse the State promptly upon rendition of
statement therefor, City's share of expense of the con-
struction engineering costs, including assessments
for indirect charges to be made at current rates,
and construction costs required to modify the traffic
control signal systems and install safety lighting
referred to herein, such share to be a sum bearing
the same proportion to the total cost of modification
of the traffic control signal systems and installation
of safety lighting as the number of legs of highways
under jurisdiction of City at the intersections in-
volved, bears to the total number of legs of highways
at such intersections.
It is estimated that City's share is St 12,000. The
actual amount of City's share is to be determined after
award and completion of the construction contract.
(b) To reimburse State for City's proportionate share of
the cost of general maintenance and operation of said
traffic control signal systems in the manner provided
in that Agreement for Maintenance of State highways
in the City which is in effect at the time said costs
arise.
(c) City shall maintain and operate the entire safety
lighting as constructed.

BE IT FURTHER RESOLVED that the Mayor and City Clerk
be and they are hereby authorized to execute said agreement for
and on behalf of the City of Anaheim.
THE FOREGOING RESOLUTION is approved and signed by me
this 10th day of September 1963.
