63-0684WHEREAS, the City Planning Commission of the City of
Anaheim did receive a request for a Conditional Use Permit from
WILLIAM C. GARRETT, JR., 1202 North East Street, Anaheim,
California, and RICHARD V. HATHCOCK, 1202 East Kenwood Avenue,
Anaheim, California, for a Conditional Use Permit to construct
a service station on the following described property situated
in the City of Anaheim, County of Orange, State of California,
to wit:
PARCEL 1:
That portion of the south half of the southwest quarter of
the northwest quarter of the southwest quarter of Section 2,
Township 4 South, Range 10 West, in the Rancho San Juan Cajon
de Santa Ana, in the City of Anaheim, County of Orange, State
of California, as said Section 2 is shown on a map of Golden
State Tract No. 2, recorded in Book 4, page 68 of Miscellane-
ous Maps, in the Office of the County Recorder of said County,
described as follows:
Beginning at the southwest corner of the said northwest quarter
of the southwest quarter of Section 2; thence East 200.15 feet
along the southerly line of said northwest quarter; thence at
right angles North 135.00 feet; thence West 201.77 feet to
the westerly line of said northwest quarter; thence
South 0 41' 20 East 135.01 feet to the point of beginning.
PARCEL 2:
AND WHEREAS, the City Planning Commission did hold a
public hearing at the City Hall in the City of Anaheim upon
said request on July 8 ,19 63 notices of which
said public hearing were duly given as required by law and the
provisions of Title 18, Chapter 18.76 of the Anaheim Municipal
Code; and
RESOLUTION NO. 63R 684
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM DENYING CONDITIONAL USE
PERMIT NO. 446
Lot 9 of Tract No 2022, in the City of Anaheim, County of
Orange, State of California, as per map recorded in Book 58,
pages 24 and 25 of Miscellaneous Maps, in the Office of the
County Recorder of said County.
WHEREAS, said Commission, after due inspection, inves-
tigation and studies made by itself and in its behalf and after
due consideration of all evidence and reports offered at said
hearing, did adopt its Resolution No. 828 Series 1963
denying Conditional Use Permit No. 446
and
WHEREAS, thereafter, within twenty -two days from the
date of the adoption of said resolution, the City Council did
elect, upon its own motion, to review the action of the City
Planning Commission in denying said Conditional Use
Permit and did thereupon fix the 13th day of August
19 63 as the time and the Council Chamber in the City Hall

of the City of Anaheim as the place for a public hearing upon
said Conditional Use Permit, and notices of such public hearing
were duly given as required by law and the provisions of Title
18, Chapter 18.76 of the Anaheim Municipal Code; and
WHEREAS, at the time and place fixed for said public
hearing, the City Council did duly hold and conduct such hear-
ing and did give all persons interested therein an opportunity
to be heard and did receive evidence and reports; and
WHEREAS, the City Council does find, after careful
consideration of the recommendations of the City Planning
Commission and all evidence and reports offered at said hearing,
that Conditional Use Permit No. 446 should be denied.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the action of the City Planning Commis-
sion denying Conditional Use Permit No. 446 be, and the
same is hereby sustained and that the request of William
C. Garrett, Jr., and Richard V. Hathcock for a Conditional Use
Permit to construct a service station on the hereinbefore
described property, be and the same is hereby denied.
THE FOREGOING RESOLUTION is approved and signed by me
this 13th day of August 19 63
