63-0678RESOLUTION NO. 63R -678 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Pro- ceedings No. 62 -63 -64 to consider an amendment to Title 18 of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence and reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon the Planning Commission did duly adopt a resolu- tion containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that a certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings, and recommendation of the City Planning Commission the City Council did fix the 13th day of August 19 63 as the time and the City Council Chambers in the City Hall of the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said prop- erty, hereinafter described, from the zone or zones in which it is now situated, and the incorporation thereof in the zone or zones hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing, and did give all persons interested therein an oppor- tunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: 62 -63 -64 PORTION "A The East half of the West half of the Northeast quarter of the Northeast quarter of Section 14, Town- ship 4 :youth, Range 11 West in the Rancho Los Coyotes as said Section is shown on the map recorded in Book 51, Page 11 of Miscellaneous Maps, records of said Orange County, EXCEPTING THEREFROM that portion lying South of a line perpendicular to the Easterly line of said East half at the point distant Southerly measured along said East line 254.73 feet from the Northeast corner thereof. PORTION "B The East half of the West half of the Northeast quarter of the Northeast quarter of Section 14, Township 4 South, Range 11 West in the Rancho Los Coyotes as said Section is shown on the map recorded in Book 51, Page 11 of Miscellaneous Maps, records of said Orange County EXCEPTING THEREFROM that portion lying Northerly of a line perpendicular to the East line of said East half at the point distant Southerly measured along said East line 254,73 feet from the Northeast corner thereof, be excluded from R -A, RESIDENTIAL- AGRICULTURAL ZONE, and incor- porated in the following zones, upon the conditions hereinafter set forth: That Portion "A" above described shall be changed to C -1, NEIGHBORHOOD- COMMERCIAL ZONE; and That Portion "B" above described shall be changed to R -3, MULTIPLE- FAMILY RESIDENTIAL ZONE. That said change of zones shall be made upon the following conditions: 1. That the owner of subject property shall pay to the City of Anaheim the sum of $25.00 per dwelling unit, to be used for park and recreation purposes, said amount to be paid at the time the building permit is issued. 2. That trash storage areas shall be provided in accordance with plans on file in the Office of the Director of Public Works and Superintendent of Streets, prior to final building inspection. 3. That the final map of Tract No. 4230, substantially in conformance with Revision No. 5 signed by Mayor Coons on this date, shall be recorded in the Office of the County Recorder of Orange County, California. 4. That plans for the development of Portion ''A' of subject property shall be subject to the approval of the Development Review Board, prior to the issuance of a building permit. 5. That covenants, conditions and restrictions to insure the perpetual maintenance of Lot 29 of Tract No. 4230, Revision No. 5, approved by the City Attorney, shall be recorded in the Office of the County Recorder of Orange County as a condition of approval of Portion "B of subject property. 6. That the completion of these reclassification proceedings is contingent upon the granting of Conditional Use Permit No. 357. 7. That a strip of land of a minimum width of six feet shall be landscaped and said landscaping maintained along the north and west boundaries, after street dedication on Portion "A," of subject prop- erty; that plans for said landscaping shall be submitted to and approved by the Superintendent of Parkway Maintenance, and that said landscaping shall be installed prior to final building inspection. 8. That tree wells shall be provided at approximately 40 -foot intervals in the Lincoln Avenue and proposed street parkways abutting Portion "A" of subject property; that plans for said tree wells and the landscaping therein shall be submitted to and approved by the Superintendent of Parkway Maintenance; and that said tree wells shall be planted prior to final building inspection. 9. That tree wells shall be provided at approximately 40 -foot intervals adjacent to the westerly and southerly boundaries of subject property, in the parkway portion of the proposed street; that plans for said landscaping shall be submitted to and approved by the Superintendent of Parkway Maintenance; and that said landscaping shall be installed prior to final building inspection. 10. That a six -foot masonry wall, reduced to 42 inches in height within 15 feet of the Lincoln Avenue right of way, shall be constructed along the westerly line of subject property, prior to final building inspection, or that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the construction of said wall. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and determined to be necessary and proper. -3- THE FOREGOING RESOLUTION is approved and signed by me this 13th day of 19 63 ATTEST (S EAL) STATE OF CALIFORNIA COUNTY OF ORANGE ss.
