63-0146RESOLUTION NO, 63R -146 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUNDARIES OF CERTAIN ZCNES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim did hold a public hearing in Reclassification Proceedings No. 62 to consider an amendment to Title to of the Anaheim Municipal Code relating to zoning, and to consider a change in the boundaries of the zone or zones hereinafter mentioned and described, and at said hearing did receive evidence an reports from persons interested therein and from its staff; and WHEREAS, within a period of forty days following said hearing thereon the Planning Commission did duly adopt a resolution containing a report of its findings, a summary of the evidence presented at said hearing, and a recommendation that the proposed amendment be adopted by the City Council and that certain zone or zones be changed as hereinafter set forth; and WHEREAS, upon receipt of said resolution, summary of evi- dence, report of findings, and recommendation of the City Planning Commission the City Council did fix the 19th day of February 19 63 as the time and the City Council Chambers in the City Hall of tie City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone or zones in which it is now situated, and the incorporation thereof in the zone or zones hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing the City Council did hold and conduct such public hearing, and did give all persons interested therein an opportunity to be heard, and did receive evidence and reports, and did thereupon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings, and recommendation; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended and that the following described property, situated in the City of Anaheim, County of Orange, State of California, to wit: Lot No. 99 of Tract No. 1453 as shown on a map recorded in Book 42, pages 41 and 42 of Miscel- laneous Maps, Records of Orange County, California. -1- 62 -63 -57 be excluded from R -1, ONE- FAMILY RESIDENTIAL ZONE, and incorporated in C -1, NEIGHBORHOOD- COMMERCIAL ZONE, upon the following conditions: 1. That subject property shall be developed substan- tially in accordance with plans marked "Exhibits Nos. 1 and 2," except as amended herein, on file with the City of Anaheim. 2. That a strip of land of a minimum width of 6 feet, abutting the front property line, shall be land- scaped and said landscaping maintained; that plans for said landscaping shall be submitted to and approved by the Superintendent of Parkway Main- tenance; and that said landscaping shall be in- stalled prior to final building inspection. 3. That a minimum building setback of 50 feet shall be established and maintained from the westerly boundary of the alley on the west side of subject property for any 2 -story structures, and no windows shall be installed in the rear of the second story of any 2 -story buildings. 4. That any signs proposed to be installed on subject property, other than unlighted signs having a maximum area of 8 square feet, shall be submitted to the City Council for approval. 5. That the owners of subject property shall place of record City of Anaheim C-1 Deed Restrictions, approved by the City Attorney, which restrictions shall limit the uses of subject property to busi- ness and professional offices only. 6. That off street parking facilities shall be provided as required by the Anaheim Municipal Code, prior to final building inspection. 7. That no existing residential structure shall be used for commercial purposes unless remodeled to com- mercial standards. 8. That a sufficient building setback from the existing alley shall be established to permit proper turning radius into the parking spaces; and that pipes or concrete posts shall be installed on the side of the alley opposite the subject property, as required by the Director of Public Works and Superintendent of Streets, to protect the residential properties from damages to fences by cars that might be turning into or backing out of subject property. 9. That the owners of subject property shall dedicate to the City of Anaheim all vehicular access rights to and from Harbor Boulevard. 10. That the owners of subject property shall deed to the City of Anaheim a strip of land 45 feet in width, from the center line of the street, along Harbor Boulevard for street widening purposes. 2 ATTEST: 11. That the damaged and /or hazardous sidewalks along Harbor Boulevard shall be repaired as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer. 12. That adequate areas for trash storage, accessible to trash -truck pickup, shall be provided as deter- mined and required by the Street Maintenance and Sanitation Division of the Public Works Department, which areas shall be enclosed by a solid fence or wall prior to final building inspection. 13. That the owners of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot, along Harbor Boulevard, for street lighting purposes. 14. That Conditions Nos. 5, 9, 10 and 13 above mentioned, shall be complied with within a period of 180 days from date hereof or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and deter- mined to be necessary and proper.
