A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AUTHORIZING THE COMPROMISE OF
CERTAIN EMINENT DOMAIN LITIGATION.
WHEREAS, heretofore, by its resolution duly adopted
and passed on the 22nd day of November, 1960, the City of
Anaheim authorized and directed the initiation of condemnation
proceedings which resulted in the commencement of Orange
County Superior Court Case No. 94449, being entitled "City of
Anaheim vs. A. Anton, et al. and
WHEREAS, Defendant Jesus Samarippa has offered to
deed a portion (owned by said defendant) of the property
sought to be condemned by the City of Anaheim to the City
for a total consideration of $5,850.00; and
WHEREAS, said property was appraised at $5,850.00
as recently as December 26, 1962, and the City Council of
the City of Anaheim finds that the sum of $5,850.00 is a fair
and reasonable amount to be paid for the property condemned.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the Director of Finance be, and
he is hereby, authorized and directed to deliver to the City
Attorney's Office the sum of $5,850.00, payable to Jesus
Samarippa, to be delivered by the City Attorney to her
attorney when the City Attorney holds a grant deed in favor
of the City of Anaheim, executed by said Jesus Samarippa and
conveying Lot 30 of the Mary Goodman Tract.
THE FOREGOING RESOLUTION is approved and signed by
me this 13th day of February, 1963.
