RESOLUTION NO. 63R 86
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AUTHORIZING THE COMPROMISE OF
CERTAIN EMINENT DOMAIN LITIGATION.
WHEREAS, heretofore, by its Resolution No. 63R -20
the City of Anaheim authorized and directed the initiation of
condemnation proceedings which resulted in the commencement of
Orange County Superior Court Case No. 109722, being entitled
"City of Anaheim, a Municipal Corporation, vs. Marie Feraud, et
al. and
WHEREAS, the parties to said litigation have entered
into a Stipulation of Facts and As To Value, agreeing upon the
amount of consideration to be paid and the costs incurred in
connection therewith; and
WHEREAS, the parties to said litigation intend to
submit such matter to the Court for its judgment, and Plaintiff
City will require certain funds to complete said litigation and
acquire the property therein involved; and
WHEREAS, the City Council of the City of Anaheim finds
that the sum of $52,000.00 is a fair and reasonable amount to be
paid for the property condemned; that the sum of $19.00 represents
the costs incurred by defendants.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that the Finance Director be, and he is here-
by, authorized and directed to deliver to the City Attorney's
Office the sum of $52,019.00, payable to Marie Feraud, Antonin
Feraud and Marguerite Feraud, to be paid by the City Attorney to
said Marie Feraud, Antonin Feraud and Marguerite Feraud, when the
City Attorney has filed a Stipulation of Facts and As To Value
and a Judgment in Condemnation in said Superior Court action.
THE FOREGOING RESOLUTION is approved and signed by me
this 5th day of February, 1963.
