63-0069WHEREAS, the City Council did heretofore, to wit, on
August 7, 1962, adopt Resolution No. 62R -733 granting Condi-
tional Use Permit No. 245 permitting the establishment and
operation of a trailer park on the property therein described,
subject to certain conditions set forth in said resolution;
and
follows:
RESOLUTION NO. 63R -69
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AMENDING RESOLUTION NO. 62R -733
GRANTING CONDITIONAL USE PERMIT NO. 245.
WHEREAS, Condition No. 9 of said resolution reads as
"9. That an access road of a minimum width of
40 feet shall be provided; and if this road
or street is to be dedicated, the 40 -foot
roadway shall be in a 64 -foot right of way,
and shall be constructed to City standards."
AND WHEREAS, upon further consideration the City CourL1
finds that said Condition No. 9 should be amended to provide for
the dedication to the City of Anaheim of an access road to sub-
ject property of a minimum width of 64 feet, said road to be
improved as hereinafter specified.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that Resolution No. 62R -733, adopted August
7, 1962, granting Conditional Use Permit No. 245, be, and the
same is hereby amended by amending Condition No. 9 thereof to
read as follows:
"9. That the following described property shall
be transferred to the City of Anaheim by
easement deed, for street and highway pur-
poses:
PARCEL NO. 1: The northerly 32 feet of the
westerly 380 feet of the easterly 410 feet
of Lot 4 of the Stockwell Subdivision in the
City of Anaheim, County of Orange, State of
California, as per map recorded in Book 6,
page 10 of Miscellaneous Maps, in the office
of the County Recorder of said. County.
EXCEPT that portion thereof included within
the land designated and described as Parcel
No. B1-1208 in an action in eminent domain
entitled. Orange County Flood Control District
vs. Ernest M. Carlson, et al., Case No. 75207,
Superior Court, Orange County, as per notice
of action recorded January 9, 1953 in Book
4160, page 109, Official Records of Orange
County.
PARCEL NO. 2: The southerly 32 feet of the
westerly 380 feet of the easterly 410 feet
(measured from the center line of Raymond
Avenue) of Lot 3 of the Stockwell Subdivision
in the City of Anaheim, County of Orange,
State of California, as per map recorded
in Book 6, page 10 of Miscellaneous Maps,
in the office of the County Recorder of
said County.
EXCEPT that portion thereof included within
the land described as Parcel No. B1-1209 in
the Lis Pendens filed in Superior Court Case
No. 75207 in and for the County of Orange,
a copy of which was recorded January 9, 1958
in Book 4160, Page109 of Official Records in
the Office of said County Recorder.
That Parcel No. 1 above described shall be
improved to City standards as required by
the City Engineer and in accordance with
plans and specifications on file in the Office
of the City Engineer; and that a travelway
shall be provided on the north twelve (12)
feet of Parcel No. 2 above described."
BE IT FURTHER RESOLVED that in all other respects said
Resolution No. 62R -733 be, and remain in full force and effect.
THE FOREGOING RESOLUTION is approved and signed by me
this 29th day of January, 1963.
