63-0065RESOLUTION NO. 63R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING SHOULD BE AMENDED AND THAT THE BOUND- ARIES OF CERTAIN ZONES SHOULD BE CHANGED. WHEREAS, the City Planning Commission of the City of Anaheim has heretofore duly passed and adopted a resolution recommending denial of a change in the boundaries of the zone or zones hereinafter mentioned and described, after having fixed a time and place for the holding of a public hearing thereon in the manner and as prescribed in Title 18 of the Anaheim Municipal Code, and after having duly held and conducted such public hearing to consider said proposed change of zone or zones, and after having received evidence and reports from persons interested therein; and WHEREAS, within a period of forty 0) days following the hearing thereon, the Planning Commission did duly announce by formal resolution its findings of facts and declare its opinions and reasons for recommending denial of said proposed change in the boundaries of the zone or zones hereinafter mentioned and described; and WHEREAS, upon receipt of said resolution, summary of evidence, report of findings and recommendation of the City Plan- ning Commission, the City Council did fix the 22nd day of January 1963, as the time, and the City CUUFFil Chambers in the City Hall the City of Anaheim as the place for a public hearing upon said proposed amendment to Title 18 of the Anaheim Municipal Code, and the exclusion of said property, hereinafter described, from the zone in which it is now situated and the incorporation thereof in the zones hereinafter set forth; and did give notice thereof in the manner and form as provided in said Title 18 of said Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports and did there- upon consider the summary of evidence presented at said public hearing before the Planning Commission, its report of findings and recommendations; and WHEREAS, the City Council does find and determine that the amendment to Title 18 of the Anaheim Municipal Code should be adopted and that the property hereinafter described should be excluded from the zone or zones in which it is now situated, and incorporated in the zone or zones as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Title 18 of the Anaheim Municipal Code be, and the same is hereby amended, and that all of the property and area situated In the City of Anaheim, County of Orange, State of California, described as follows: Those portions of Vineyard Lot G5, as said lot is delineated upon a map of the lands of Anaheim, recorded in Book 4, Deeds, pages 629 and 630, Records of Los Angeles County, California, described as follows: 62 -63 -49 PARCEL 1. Commencing at a point on the South side of Santa Ana Street 204.5 feet North 75 -1/4 East from the South- east intersection of Santa Ana and Palm Street; thence North 75 -1/4 East along the South side of Santa Ana Street 613.5 feet to stake marked 4 C. K.; thence at right angles Southerly 213 feet to a stake marked H. C. K.; thence at right angles Westerly 613.5 feet to a stake marked 4 C. K.; thence at right angles Northerly 213 feet to the point of beginning; EXCEPTING THEREFROM that portion described as follows: Beginning at the Northwesterly corner of Lot No. 22, as said lot is shown on map of Tract No. 365, recorded in Book 15, page 14, Miscellaneous Maps, records of said Orange County; thence North 15 28' 30" West along the Northerly extension of the Easterly line of South Dickel Street, as said street is shown on Tract No. 365, a distance of 95.00 feet; thence North 74 24' 45" East 109.78 feet; thence South 15 28' 30" East 95.00 feet to the Northeast corner of said Lot No. 22; thence South 74 24' 45" West along the Northerly line of said Lot No. 22, 109.78 feet to the point of beginning; ALSO EXCEPTING THEREFROM the Northerly 10 feet of said land. PARCEL 2. Commencing on the South side of Santa Ana Street at a point 818 feet North 75 -1/4 East from the Southwest corner of Santa Ana and Palm Street; running thence along the South side of Santa Ana Street 74 -1/4 East, 92 feet; thence Southerly and parallel with Lemon Street, 213 feet; thence at right angles Westerly 92 feet to a point 818 feet North 75 -1/4 East of Palm Street; thence at right angles Northerly parallel with Lemon Street, 213 feet to the point of beginning. be excluded from R -2, TWO- FAMILY RESIDENTIAL ZONE, and incor- porated in M -1, LIGHT MANUFACTURING ZONE, upon the following conditions: 1. That sidewalks shall be installed on Santa Ana Street as required by the City Engineer and in accordance with standard plans and specifications on file in the Office of the City Engineer, prior to final building inspection. 2. That subject property shall be developed substan- tially in accordance with plans marked "Exhibit No. 3," on file with the City of Anaheim. 3. That the building line setback shall be 25 feet from the new property line; and that the setback area shall be landscaped and said landscaping maintained. 2 ATTEST: 4. That the owners of subject property shall deed to the City of Anaheim a strip of land 10 feet in width (or such lesser amount as may be re- quired by the City Engineer) along Santa Ana Street, for street widening purposes. 5. That a modified cul -de -sac shall be provided at the terminus of Clementine Street prior to final building inspection, which cul -de -sac shall be subject to the approval of the City Engineer. 6. That adequate areas for trash storage, accessible to trash -truck pickup, shall be provided as determined and required by the Street Maintenance and Sanitation Division of the Public Works Department, which areas shall be enclosed by a solid fence or wall prior to final building in- spection. 7. That the owners of subject property shall deed to the City of Anaheim all access rights to and from Clementine Street and to and from the alley abutting subject property. 8. That a 6 -foot masonry block wall shall be con- structed along the southerly property line prior to final building inspection. 9. That the parkway area shall be landscaped, or concreted solid, and if concreted solid, 5 -foot square tree wells shall be provided at 40 -foot intervals and trees shall be planted therein; that said landscaping shall be installed prior to final building inspection, and shall be subject to the approval of the Superintendent of Parkway Maintenance. 10. That Conditions Nos. 4 and 7 above mentioned shall be complied with within a period of 180 days from date hereof, or such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an ordinance amending Title 18 of the Anaheim Municipal Code to accomplish the objects herein found and deter- mined to be necessary and proper.
