63-0057RESOLUTION NO. 63R -57 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AMENDING RESOLUTION NO. 62R-690 GRANTING CONDITIONAL USE PERMIT NO. 259. WHEREAS, the City Council did heretofore, to wit, on July 24, 1962, adopt Resolution No. 62R -690 granting Conditional Use Permit No. 259 permitting the establishment of a Hofbrau Restaurant for the sale of food, and incidentally for the sale of beer, and a repair garage, on the property described in said resolution, subject to certain conditions therein set forth; and WHEREAS, Condition No. 3 of Resolution No. 62R -690 reads as follows: "3. The size and shape of the site proposed for the use is adequate to allow the full develop- ment of the proposed use in a manner not detri- mental to the particular area nor to the peace, health, safety and general welfare." AND WHEREAS, one of the applicants for said Conditional Use Permit has requested that said Condition No. 3 be deleted from said resolution; and WHEREAS, the City Council does find that said request should be granted, and that said resolution should be amended by deleting Condition No. 3 and by adding thereto the following con- ditions: (a) That all operations in connection with the repair garage and any activities in the garage shall be wholly contained within the building at all times. (b) That the owners of subject property shall deed to the City of Anaheim an easement for storm drain purposes upon, along, over and across subject property as required and determined necessary by the City Engineer. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Resolution No. 62R -690, adopted July 24, 1962, granting Conditional Use Permit No. 259, be, and the same is hereby amended as follows: 1. That Condition No. 3 of Resolution No. 62R -690 be, and the same is hereby deleted. 2. That the following conditions be, and the same are hereby added to said Resolution No. 62R- 690: (a) That all operations in connection with the repair garage and any activities in the garage shall be wholly contained within the building at all times. 1 BE IT FURTHER RESOLVED that in all other respects said Resolution No. 62R -690 be, and remain in full force and effect. THE FOREGOING RESOLUTION is approved and signed by me this 22nd day of January, 1963.
