1962-1098WHEREAS, the City Planning Commission of the City of Anaheim did receive a request for a Conditional Use Permit from MINORU and HATSUE SHIOTA, 3139 Orange Avenue, Anaheim, California, to construct a service station on Parcel No. 1 more particularly hereinafter described, establish a neighborhood shopping center on Parcel No. 2 more particularly hereinafter described, and construct a two -story multiple- family planned unit development on Parcel No. 3 more particularly hereinafter described. Said parcels are situated in the City of Anaheim, County of Orange, State of California, and are more particularly described as follows: RESOLUTION NO. 62R -1098 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DENYING CONDITIONAL USE PERMIT NO. 321. PARCEL NO. 1 A portion of Section 14, Township 4 South, Range 11 West, in Rancho Los Coyotes, as shown on a map thereof recorded in Book 51, page 7, et seq., Miscellaneous Maps, records of Orange County, described as follows: Beginning at the center of Section 14, Township 4 South, Range 11 West, said point being the center line intersection of Western Ave. and Orange Ave.; thence North 0 16' 15" West 160.00 feet; thence North 89 36' 15" East 160.00 feet; thence South 0 16' 15" East 160.00 feet;thence South 89 36' 15" West 160.00 feet to the point of beginning. PARCEL NO. 2 That portion of Section 14, Township 4 South, Range 11 West, in Rancho Los Coyotes, as shown on a map thereof recorded in Book 51, page 7, et seq., Miscellaneous Maps, records of Orange County, described as follows: Beginning at the center of Section 14, Township 4 South, Range 11 West, said point being the center line intersection of Western Ave. and Orange Ave.; thence North 0 16' 15" West 160.00 feet to the true point of beginning; thence North 0 16' 15" West 100.42 feet; thence North 89 36' 15" East 240.00 feet; thence South 0 16' 15" East 260.42 feet; thence North 89 36' 15" East 80.00 feet; thence North 0 16' 15" West 160.00 feet; thence North 89 36' 15" East 160.00 feet to the true point of beginning. Eng (2) PARCEL NO. 3 That portion of Section 14, Township 4 South, Range 11 West, in Rancho Los Coyotes, as shown on a map thereof recorded in Book 51, page 7, et seq., Miscellaneous Maps, records of Orange County, described as follows: Beginning at the center of Section 14, Township 4 South, Range 11 West, said point being the center line intersection of Western Ave. and Orange Ave.; thence North 016' 15" West 260.42 feet; thence North 89 36' 15" East 240.00 feet to the true point of beginning; thence North 89 36' 15" East 484.52 feet; thence South 0 16' 15" East 260.42 feet; thence South 89 36' 15" West 484.52 feet; thence North 0 16' 15" West 260.42 feet to the feet; point of beginning. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said request on November 14, 1962, notices of which said public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection, investigation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing, did adopt its Resolution No. 537, Series 1962 -63, denying Conditional Use Permit No. 321; and WHEREAS, thereafter, within twenty -two days from the date of the adoption of said resolution, the City Council did elect, upon its own motion, to review the action of the City Planning Commission in denying said Conditional Use Permit and did thereupon fix the 18th day of December, 1962, as the time and the Council Chamber in the City Hall of the City of Anaheim as the place for a public hearing upon said Conditional Use Permit, and notices of such public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council does find, after careful consideration of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing, that Conditional Use Permit No. 321 should be denied; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commission denying Conditional Use Permit No. 321 be, and the same is hereby sustained, and that the request of MINORU and HATSUE SHIOTA, 3139 Orange Avenue, Anaheim, California, for a Conditional Use Permit to construct a service station on Parcel No. 1, establish a neighborhood shopping center on Parcel No. 2 and construct a two -story multiple family planned unit development on Parcel No. 3, all of said parcels being more particularly hereinabove described, be and the same is hereby denied.
