1962-1091RESOLUTION NO. 62R -1091 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM GRANTING CONDITIONAL USE PERMIT NO. 316 WHEREAS, the City Planning Commission of the City of Anaheim did receive an application from LIN -HURST CLUB, a Corporation 219 North Siesta Street Anaheim, California for a Conditional Use Permit to establish a private recreational faci ity on the following described property situated in the City of Anaheim, County of Orange, State of California, to wit: That portion of the west half of the southeast quarter of the southeast quarter of section 7, Township 4 South, Range 10 West, in the Rancho Los Coyotes, City of Anaheim, County of Orange, State of California, as per map recorded in Book 51, page 10 of Miscellaneous Maps, in the office of the county recorder of said county, described as follows: Beginning at the northeast corner of lot 39 of Tract No. 2625, as per map recorded in Book 94, pages 9, 10 and 11 of said Miscellaneous Maps, said point being on the east- erly line of said west half of the southeast quarter of the southeast quarter of section 7; thence along said easterly line North 0° 16' 20" West 80.59 feet to the North line of said west half; thence South 89 25' 29" West 165.02 feet along said North line; thence South 0 16' 20" East 90.16 feet to the northwesterly line of Wpodley Avenue as shown on said map of Tract No. 2625; thence along the boundary line of said Tract No. 2625 North 67 23' 02" East 9.30 feet to the beginning of a non tangent curve, concave to the South having a radius of 66.00 feet a radial line to the beginning of said curve bears North 0 21' 05" West, easterly 34.00 feet along said curve, North 29 09' 53" East 16.09 feet and North 89 01' 59" East 116.00 feet to the point of beginning. EXCEPT that portion thereof included within Tract No. 1633, as per map recorded in book 47 page 50 of said Miscellaneous Maps. AND WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim upon said application on November 14 19 62 notices of which said public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, said Commission, after due inspection investi- gation and studies made by itself and in its behalf and after due consideration of all evidence and reports offered at said hearing did adopt its Resolution No. 531 Series 1962 -63 granting Conditional Use Permit No. 316 upon the conditions therein set forth and -1- WHEREAS, thereafter, within twenty -two (22) days from the date of the adoption of said resolution, a written appeal was filed with the City Council protesting the action of the City Planning Commission in granting, said Conditional Use Permit and said appeal was set for public hearing on December 18 19 62 at the City Hall, in the City of Anaheim, and notices of suc public hearing were duly given as required by law and the provisions of Title 18, Chapter 18.76 of the Anaheim Municipal Code; and WHEREAS, at the time and place fixed for said public hearing, the City Council did duly hold and conduct such hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports; and WHEREAS, the City Council finds, after careful consideration of the recommendations of the City Planning Commission and all evidence and reports offered at said hearing, that: 1. The proposed use is properly one for which a Conditional Use Permit is authorized by the Anaheim Municipal Code. 2. The proposed use will not adversely affect the adjoining land uses and the growth and develop- ment of the area in which it is proposed to be located. 3. The size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety and general welfare. 4. The traffic generated by the proposed use will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. 5. The granting of the Conditional Use Permit under the conditions imposed will not be detrimental to the peace, health, safety and general welfare of the citizens of the City of Anaheim. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the action of the City Planning Commis- sion granting said Conditional Use Permit be, and the same is hereby sustained and that Conditional Use Permit No. 316 be, and the same is hereby, granted permitting the establishment of a private recreational facility on the property hereinabove described, subject to the following conditions: 1. That adequate areas for trash storage, accessible to trash -truck pickup, shall be provided as deter- mined and required by the Street Maintenance and Sanitation Division of the Public Works Department, which areas shall be enclosed by a solid fence or wall prior to final building inspection. -2- The City Council hereby reserves the right to revoke such Conditional Use Permit for good cause or failure of said owner, its successors or assigns to comply with the Anaheim Municipal Code and regulations and the conditions herein. THE FOREGOING RESOLUTION is approved and signed by me this 18th day of December, 1962. ATTEST: 2. That the swimming pool area shall be enclosed by a 6 -foot chain link fence prior to final building inspection. 3. That all requirements of Chapter 6.56 of the Anaheim Municipal Code shall be complied with. 4. That the swimming pool shall be supervised by an adult person at all times when in use, and the gate to the swimming pool shall be locked at all times when said pool is not so supervised. 5. That the remainder of subject property to the east of the swimming pool may be devoted to playgrounds, picnic area and park recreation. 6. That landscaping shall be installed and maintained in accordance with the elevations as submitted, marked "Exhibit No. 1," and on file with the City of Anaheim.
