A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AMENDING RESOLUTION NO. 62R -1067
AUTHORIZING THE COMPROMISE OF CERTAIN EMINENT
DOMAIN LITIGATION.
WHEREAS, heretofore, on the llth day of December, 1962,
by its Resolution No. 62R -1067 the City of Anaheim authorized the
compromise of certain eminent domain litigation, being Orange
County Superior Court Case No. 108677, entitled "City of Anaheim
vs. James Goodman, et al. and
WHEREAS, the dispersal of a portion of the $53,000.00
set forth in said Resolution No. 62R -1067 failed to take into con-
sideration the trust deed recorded against the Neilans property;
and
WHEREAS, said defendants have requested a further break-
down of moneys to be dispersed as follows: $10,127.86 to Insurance
Funds Mortgage Co. and $9,372.14 to William H. Neilans and Naomi T.
Neilans.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim that its Resolution No. 62R -1067 be and the same is
hereby amended by authorizing and directing the Director of Finance
to deliver to the City Attorney's Office (in lieu of $19,500.00 to
William H. Neilans and Naomi T. Neilans) $10,127.86 to Insurance
Funds Mortgage Co. and $9,372.14 to William H. Neilans and Naomi T.
Neilans.
AND BE IT FURTHER RESOLVED that except to the extent
amended herein all of the matters set forth in said Resolution No.
62R-1067 shall remain in full force and effect.
THE FOREGOING RESOLUTION is approved and signed by me
