A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM CONSENTING TO THE AMENDMENT OF C -2
DECLARATION OF RESTRICTIONS RECORDED NOVEMBER 15,
1960, IN RECLASSIFICATION PROCEEDINGS No. F- 60- 61 -22.
WHEREAS, the City Council did on December 20, 1960
adopt Ordinance No. 1535 in Reclassification Proceedings No.
F- 60 -61 -22 reclassifying the property therein described from
C -1, Neighborhood Commercial Zone to C -2, General-Commercial
Zone; and
WHEREAS, one of the conditions or requirements for the
reclassification of said property was that the owners thereof
place of record standard City of Anaheim C -2 Deed Restrictions
limiting the uses of said property to one restaurant with a
cocktail bar, and any C -1 uses, the restaurant with the cocktail
bar to be located 45 feet from the west property line and 5 feet
from the north property line, and to extend approximately 80
feet east and 40 feet south; and
WHEREAS, the City Council did receive a request from
one of the owners of subject property asking that said C -2 Deed
Restrictions be amended by eliminating therefrom the condition
limiting the uses to one restaurant with a cocktail bar, and
any C -1 uses, the restaurant with the cocktail bar to be located
45 feet from the west property line and 5 feet from the north
property line and to extend approximately 80 feet east and 40
feet south; and
WHEREAS, said request was set for public hearing in
the City Council Chambers at the City Hall in the City of
Anaheim on December 11, 1962 at the hour of 7:00 o'clock P.M.,
and notice of said public hearing was duly given; and
WHEREAS, at the time and place fixed for said public
hearing, the City Council did hold and conduct such hearing
and did give all persons interested therein an opportunity to
be heard and did receive evidence and reports, and did there-
upon consider the evidence presented at said public hearing; and
WHEREAS, the City Council does find that said request
should be granted and that said Deed Restrictions should be
amended by eliminating therefrom the condition above referred
to.
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that the C -2 Declaration of Restrictions
recorded on November 15, 1960 in Reclassification Proceedings
No. F- 60- 61 -22, in Book 5511, Page 115 of Official Records of
Orange County, California, Document No. 200913, be amended by
deleting therefrom Condition No. 6, which reads as follows:
"6. The uses of this property shall be limited
to one restaurant with a cocktail bar, and
any C -1 uses, the restaurant with cocktail
bar to be located 45 feet from the west
property line and 5 feet from the north
property line and to extend approximately
80 feet east and 40 feet south."

BE IT FURTHER RESOLVED that in all other respects
said Declaration of Restrictions shall remain unchanged.
BE IT FURTHER RESOLVED that the Mayor and City Clerk
be, and they are hereby authorized to sign a consent to the
amendment of said Declaration of Restrictions deleting there-
from said Condition No. 6.
THE FOREGOING RESOLUTION is approved and signed by me
this llth day of December, 1962.
