Purpose:
The purpose of this regulation is to establish a standard procedure for the requesting of
formal legal opinions from the City Attorney.
Procedures:
All departments wishing to obtain a formal, written legal opinion from the City Attorney
shall submit a written request approved by the Department Head for the opinion to the
City Attorney via the City Manager's Office. Upon approval, the City Manager will
forward the request to the City Attorney.
Should an emergency situation arise in which there is insufficient time to route a request
for a legal opinion through the City Manager, or the City Manager is unavailable, the
Department Head shall make the request directly to the City Attorney. The Department
Head shall advise the City Manager as soon as practical if such an emergency request is
made.
Requests for formal legal opinions shall contain sufficient facts to make the inquiry clear
and shall be backed up by the enclosure of all pertinent material relating thereto.
Requests for formal legal opinions shall indicate the urgency thereof, if any.
Only those opinions which are personally approved and signed by the City Attorney shall
be considered the City Attorney's official opinion.
