(1) Purpose:
The purpose of this regulation is to establish a policy regarding the interactive
process pursuant to Title I of the Americans with Disabilities Act of 1990 (ADA)
and the California Department of Fair Employment and Housing Act (FEHA)
which prohibit discriminating against qualified individuals with disabilities in job
application procedures, hiring, firing, advancement, compensation, job training,
and other terms, conditions, and privileges of employment.
Definition:
A "qualified individual" is an employee or applicant with a disability who, with or
without reasonable accommodation, can perform the essential functions of the job
in question.
An employer is required to make a reasonable accommodation to the known
disability of a qualified employee or applicant. An accommodation is reasonable
if it does not impose an undue hardship on the employer's business. Reasonable
accommodation can include, but is not limited to, the following:
• Changing the job duties
• Changing the work shift
• Providing leave for medical care
• Accommodating work schedules
• Relocating the work area
• Providing mechanical or electrical aids
The City of Anaheim wishes to make reasonable accommodations for job applicants and
employees with known physical or mental disabilities consistent with the law. The City
encourages employees or job applicants with disabilities to participate in a good faith,
interactive process and identify reasonable accommodations that can be made without
imposing an undue hardship on the City.

(2) Procedure:
A request for accommodation is the first step in an interactive process between
the employee or applicant and the Human Resources Department ADA
Coordinator to clarify the individual's request and to identify the appropriate
reasonable accommodation. Medical certification of the disability will be
requested. Medical certification is necessary to establish that the individual is a
qualified employee or applicant with a disability. If the individual refuses to
provide reasonable documentation, their request may not be processed.
Employees requesting an accommodation shall submit a completed Voluntary
Request for Reasonable Accommodation Form along with medical certification to
their supervisor. The employee's supervisor shall forward all documents to
Human Resources Department ADA Coordinator.
Upon receipt of the necessary documentation from the requesting party, the
Human Resources Department ADA Coordinator will conduct an interactive
process to determine what accommodation(s), if any, would be more effective and
reasonable. Employees requesting an accommodation will meet with their
supervisor and the Human Resources Department ADA Coordinator, who will
conduct an interactive process to determine what accommodation(s), if any,
would be more effective and reasonable. Reasonable accommodations may
include modifications or adjustments that enable individuals to enjoy benefits and
privileges equal to those provided to individuals without disabilities.
(3) Responsibility:
The City of Anaheim is committed to fulfilling its obligations under the
Americans with Disabilities Act and any applicable state or local laws prohibiting
discrimination against qualified individuals with disabilities.
Further, if an employee or applicant believes that he/she has been subject to
disability discrimination, the individual shall have the right to report such
discrimination to the Equal Employment Opportunity Specialist in the Human
Resources Department for prompt investigation and appropriate action.

A medical certification signed by your health practitioner should be attached to this
Accomodation Form before submitting to your supervisor.

Once you have completed this form, return it to your supervisor, or submit it directly to the
Human Resources Department ADA Coordinator.

Your request will be given thorough consideration. Upon receipt of your request, the Human
Resources Department will notify you of either the approval of your request, requirement of
additional documentation, or the time frame for consideration. In order to explore reasonable
accommodation, there is a need for the Human Resources Department to conduct an interactive
process with you regarding accommodation options. (Therefore, in this process, alternatives
may be discussed with you and you may be contacted for additional information before making a
decision). Once the Human Resources Department has reached a decision, you will be
informed of the results of your request.
