CHAPTER 2 - EMPLOYMENT PROCEDURES

Purpose:
The purpose of this regulation is to outline a systematic approach to the proper handling
of unemployment insurance claims filed against the City for former full-time or part-time
employees.
Procedures:
All separations and the reason for such a separation must be promptly reported to Risk
Management upon the separation of the employee by the Human Resources Department.
All written communication received from the State Employment Development
Department concerning a separated employee must be forwarded to Risk Management
immediately upon receipt.
Risk Management will evaluate the reason for separation of each employee to determine
the potentiality of a claim being filed. Any further information regarding the separation
of the employee determined to be necessary for proper defense of a claim will be
accumulated by Risk Management and retained for further reference in the event a claim
is filed.
Upon receipt of a notice of a claim for unemployment insurance being filed, Risk
Management will review the separation information accumulated; review with the
Department Head or Program Manager the files of the employee where necessary; and
submit the appropriate response to the Employment Development Department within the
time limitations prescribed by the California Unemployment Insurance Law.
Risk Management will prepare the necessary defense of the City in all unemployment
insurance matters submitted to appeal before an administrative law judge and the
Unemployment Insurance Appeals Board.
In any matters of an extraordinary nature before an administrative law judge or in the
civil courts involving unemployment insurance, the preparation and presentation of the
defense of the City shall be the responsibility of the City Attorney's Office with
assistance from Risk Management.

Risk Management, in the addition of the above, will prepare, audit, review or authorize
all of the following:
1. Benefit charges to the City
2. Payroll audits required by law
3. Unemployment insurance tax forms
4. Reimbursement by the City of claims paid by the State
5. Protests to the state of all improper benefit charges
Risk Management will prepare and maintain a procedural manual for all supervisory
personnel to assist in the daily activity of the City as it relates to unemployment
insurance, to assist the supervisor in hiring, promotion, disciplinary and separation
practices.
Responsibility:
There are various levels of responsibility in the City necessary to ensure compliance with
the unemployment insurance laws of California. There are as follows:
Department Heads and Program Managers.
It will be the responsibility of the department heads and program management to assure
that complete and accurate information is compiled on each active employee within their
area of responsibility. Records that should be kept on file are as follows:
1. Employee MBO statements or performance agreements/contracts.
2. All performance evaluations received by the employees.
3. All other information pertinent to the employment of that employee.
Risk Management.
Risk Management shall have the responsibility of administration of the City
Unemployment Insurance Program. It shall be the responsibility of Risk Management to
coordinate all activity regarding unemployment insurance between the State Employment
Development Department and the City, including claims handling, hearing
representation, Appeals Board representation, auditing of claims and cost controls.
