401City Of Anaheim Administrative Regulation CHAPTER 4 — CITY PROPERTY Subject: Off -Road Equipment A.R. 401 Anti Idling Policy Issue Date: March 1, 2009 Revised: April 22, 2009 Page: (1) of (3) Purpose: The purpose of this regulation is to provide guidance for compliance with California Air Resources Board (CARB) Regulations limiting idling of self-propelled diesel -fueled off -road vehicles and equipment (25 HP and up) to no more than 5 consecutive minutes. These requirements are specified in Title 13, California Code of Regulations, Section 2449 (d)(3) Idling. Idling Policy: No City of Anaheim off -road vehicle (see attached list of affected equipment) will idle for more than 5 consecutive minutes. All Contractors performing work for the City are also required to comply with this regulation. Off -road vehicle operators will turn off the engine as needed to prevent the vehicle from idling more than 5 consecutive minutes per the state regulation. All City equipment subject to this regulation will be identified by a red sticker placed inside the operating cab that states "This engine cannot idle for more than 5 minutes. It is a State environmental regulation." It is the responsibility of the vehicle operator to observe this regulation limiting engine idling. Violations of this regulation may result in discipline up to and including termination. Idling Limits and Exceptions: Any vehicle or engine subject to this regulation that may be idling for more than 5 consecutive minutes must be turned off and only restarted when work functions will resume. The idling limit does not apply to: 1. idling when queuing, (queuing does not include a vehicle waiting for materials or another vehicle to perform a function, such as a scraper waiting for a truck to deliver soil to complete a fill, or a truck being loaded by an excavator over a period of an hour) 2. idling to verify that the vehicle is in safe operating condition, 3. idling for testing, servicing, repairing or diagnostic purposes, 1 City of Anaheim Administrative Regulation 401 Page (2) of (3) 4. idling necessary to accomplish work for which the vehicle was designed (such as operating a crane, PTO, or lift gate), 5. idling required to bring the machine system to operating temperature, as specified by the manufacturer, and 6. idling necessary to ensure safe operation of the vehicle. Examples of when idling would be allowed, if applicable, are: 1. Idling when waiting in line is allowed. (Idling to wait for other vehicles or materials is not allowed.). 2. Idling to accomplish secondary functions, such as concrete agitation, load hoisting, fuel pump operation, aerial bucket operations, or other necessary functions is allowed. 3. Idling to keep equipment (including equipment windows) clear of ice and snow is allowed. 4. Idling to provide air conditioning or heat to ensure the health and safety of the operator is allowed. State CARB enforcement personnel will have the discretion to make exceptions to the idling limitations when idling is necessary to provide heating or air conditioning to ensure the health and safety of the operators. It is the responsibility of each Department head to ensure compliance with regulation guidelines. 2. Reports of violations should be made directly to the manager in charge of the equipment and to the Fleet Superintendent at 714-765-6826. 3. All violations will be investigated and corrective action taken as needed. 2 City of Anaheim Administrative Regulation 401 Page (3) of (3) Violations of this regulation may result in disciplinary action by the department against the employee violating the policy. Repeated violations of this regulation can result in disciplinary action up to and including termination. Reporting Non-compliance Issues or Repeated Violations to CARB: In the event that any City equipment is repeatedly left idling and City efforts to resolve the issue are unsuccessful, repeat offenders can be reported to the California Air Resources Board (CARB). To report repeat offenders of the idling limits, call 1-800-END-SMOG (1-800-363- 7664), or fill out a form on-line at http://www.arb.ca.gov/enf/complaints/icv.htm. The idling limits are listed in the final regulation order on page 15, section 2449(d)(3). Civil Penalties: The CARB enforcement advisory for idling is available online from CARB's website at http://www.arb.ca. o�pro _ ordiesel/guidance/idling_pdf. The enforcement advisory describes the method by which the idling policy will be enforced by CARB staff, and also states "each first time violation of the idling requirements will be assessed a minimum civil penalty of $300. Subsequent penalties can range from $1,000 to $10,000." Policy Availability and Display: An electronic copy of this regulation is available on the Anaheim Insider web page under City Clerk/City Documents/Records/Administrative Regulations. The regulation is available in hard copy form in the Public Works Maintenance Services Division Administration Offices located at 955 S. Melrose Street, Anaheim CA. 92805. This regulation will also be posted in each piece of off -road equipment subject to this regulation in the form of a red sticker with white text that states: "This engine cannot idle for more than 5 minutes. It is a State environmental regulation." This Administrative Regulation will be reviewed and/or updated as needed on an annual basis no later than July 1 of each year.
