1960-5903RESOLUTION NO. 5903 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AMENDING RESOLUTION NO. 3656 IN RECLASSIFICATION PROCEEDINGS NO. F- 56- 57-30. WHEREAS, the City Council of the City of Anaheim did heretofore, to wit, on Januaryl5, 1957, adopt Resolution No. 3656 finding and determining that all of the property and area situated in the City of Anaheim, County of Orange, State of California, described as follows: Lots 1, 3, 4 and 5 in Tract No. 2637, should be changed from R -1, SINGLE FAMILY RESIDENTIAL ZONE to C -1, NEIGHBORHOOD- COMMERCIAL ZONE and C -3, HEAVY COMMERCIAL ZONE, as more particularly set forth in said resolution, and that Article IX, Chapter 2 of the Anaheim Municipal Code should be amended to accomplish said change of zones; and WHEREAS, thereafter, on or about March 11, 1959, the owner of Lot No. 5 of said Tract No. 2637 filed an appli- cation with the City Planning Commission requesting reclassifi- cation of Lot 5 only of said Tract No. 2637, and said lot was, by Ordinance No. 1375 of the City of Anaheim, adopted August 11, 1959, changed from R -1, SINGLE- FAMILY RESIDENTIAL ZONE to C -i, NEIGHBORHOOD COMMERCIAL ZONE; and WHEREAS, the City Council finds that the property described in Resolution No. 3656 as Lot No. 1 in Tract No. 2637 has been resubdivided since the adoption of said resolu- tion and is now described as Lots 1 to 19, both inclusive, of Tract No. 3203; and WHEREAS, the City Council does further find that that portion of subject property proposed to be reclassified to C -3, and formerly described as the Southeast corner of Lot No. 1 of Tract 2637, 160 feet by 160 feet, is now described as Lot 9 of Tract 3203; and WHEREAS, the City Council finds that said Resolution No. 3656 should,therefore,be amended by excluding Lot No. 5 from the property proposed to be reclassified; by correcting the description of the remainder of the area, and by correct- ing the description of the property proposed to be changed to C -3, HEAVY- COMMERCIAL ZONE; and WHEREAS, the said City Council does further find that an ordinance completing said proposed change of zones and amending Article IX, Chapter 2 of the Anaheim Municipal Code has never been adopted; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Resolution No. 3656, in reclassi- fication proceedings No. F- 56- 57 -30, be and the same is hereby amended as follows: 1. That Lot 5 of Tract 2637 be, and the same is hereby excluded from the property proposed to be reclassified. 2. That the description of the property and area proposed to be reclassified be changed to read as follows: Lots 3 and 4'in Tract 2637, and Lots 1 to 19, both inclusive, of Tract 3203. 3. That the description of that portion of the area proposed to be changed to C -3, HEAVY COMMERCIAL ZONE, be amended to read: Lot 9 of Tract 3203. BE IT FURTHER RESOLVED that in all respects, except as amended by Resolution No. 3839, adopted April 23, 1957, said Resolution No. 3656 be, and remain in full force and effect. AND BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby, authorized and directed to prepare and sub- mit to the City Council an amendment to Article IX, Chapter 2 of the Anaheim Municipal Code to accomplish the object herein found and determined to be necessary and proper.
