1960-5892RESOLUTION NO. 5892 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT AN AMENDMENT TO ARTICLE IX, CHAPTER 2 OF THE ANAHEIM MUNICIPAL CODE AND THE ZONING MAP OF THE CITY MADE A PART THEREOF SHOULD BE ADOPTFfl, CHANGING THE BOUNDARIES OF CERTAIN OF THE ZONES THEREBY ESTABLISHED SO AS TO EXCLUDE THE PRO- PERTY HEREINAFTER DESCRIBED FROM THE R -A ZONE AND TO INCORPORATE IT IN THE P -L ZONE AND THE M -1 ZONE AS HEREINAFTER SET FORTH. WHEREAS, the City Council of the City of Anaheim did heretofore, to wit, on the 23rd day of February, 1960, adopt Resolution No. 5845 in Reclassification No. F- 59- 60 -82, initiating and proposing the adoption of an amendment to Article IX, Chapter 2 of the Anaheim Municipal Code and the zoning map of the City made a part thereof so as to exclude Lot 16 in Block K of the Kraemer Tract, as shown on a map recorded in Book 12, Pages 87 and 88 of Miscellaneous Records of Los Angeles County, California, from the R -A, Residential Agricultural Zone and to incorporate a strip of said land 50 feet in width along Anaheim Road and a strip 50 feet in width along La Palma Avenue in the P -L, Parking Landscaping Zone, and to incorporate the balance of said land in the M -1, Light Manufacturing Zone, upon certain conditions set forth in said resolution, and WHEREAS, said proposed amendment and change of zones was referred to the City Planning Commission for a report of findings, summary of hearing and recommendation and said Planning Commission was directed to hold at least one public hearing in the City Hall in the City of Anaheim in the manner prescribed by law to consider said proposed amendment and zone change, and WHEREAS, as directed by said Resolution No. 5815, the City Planning Commission did upon March 7, 1960, hold a public hearing at the City Hall in the City of Anaheim to consider said proposed amendment and zone change, notice of which was given as required by law, and WHEREAS, on said date the City Planning Commission did adopt its Resolution No. 178,conta.ining a report of its findings, a summary of the evidence presented at said hearing and a recommendation that the said proposed amendment be adopted by the City Council, and WHEREAS, upon receipt of a copy of said Resolution No. 178 so adopted by the Planning Commission, the City Council did thereupon fix the 22nd day of March, 1960, as the time and the City Council Chambers in the City Hall in the City of Anaheim as the place for a public hearing to consider said proposed amendment and the exclusion of the property hereinabove -1- F 59 -60 mentioned from the zone in which it is now situated and the incorporation thereof in the zones as proposed in Resolution No. 5845 adopted by the City Council on the 23rd day of February, 1960, and as recommended by the City Planning Commission by its Resolution No. 178, and WHEREAS, at the time and place fixed for said public hearing, the City Council did hold and conduct such public hearing and did give all persons interested therein an opportunity to be heard and did receive evidence and reports, and did consider the summary of evidence presented to the City Planning Commission at its public hearing held on March 7, 1960, as set forth in Resolution No. 178, and did consider the report of findings and recommendation of the Planning Commission, and WHEREAS, the City Council does find and determine that the amendment to Article IX, Chapter 2 of the Anaheim Municipal Code and the zoning map of the City of Anaheim made a part thereof, initiated and proposed by Resolution No. 5845 adopted on February 23, 1960, should be adopted and that the property hereinabove described should be excluded from the zone in which it is now situated and incorporated in the zones as set forth in said resolution and as recommended by the Planning Commission, and as here- inafter more particularly set forth; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that Article IX, Chapter 2 of the Anaheim Municipal Code and the zoning map of the City made a part thereof be, and the same is hereby amended and that Lot 16 in Block K of the Kraemer Tract, as shown on a map recorded in Book 12, Pages 87 and 88 of Miscellaneous Records of Los Angeles County, California, be excluded from the R -A, Residential Agricultural Zone and that a strip of said land 50 feet in width along Anaheim Road and a strip 50 feet in width along La Palma Avenue be incor- porated in P -L, Parking Landscaping Zone and that the balance of said property be incorporated in the M -1, Light Manufacturing Zone upon the following conditions: 1. The owners of said property deed to the City of Anaheim, for street widening purposes, a strip of land 45 feet in width, extending southerly from and along the center line of Anaheim Road, and a strip of land 53 feet in width, extending northerly from and along the center line of La Palma Avenue. 2. All engineering requirements of the City of Anaheim along La Palma Avenue and Anaheim Road, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other pertinent work, be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineer, and that said engineering requirements or improvements be installed at the time the property is developed. -2- 3. The owners of said property either: (a) Pay to the City of Anaheim at the time said property is developed the sum of $2.00 per front foot on both La Palma Avenue and Anaheim Road for street lighting purposes, or (b) Install street lights in accordance with plans and specifications approved by the Office of the City Engineer. 4. Approval of the Orange County Flood Control District be obtained with reference to the development of said property. 5. The owners of said property place of record M -1 deed restrictions approved by the City Attorney. 6. Conditions Nos. 1 and 5 hereof be satisfied within 90 days after this proposal is adopted by ordinance or resolution of the City Council or within such further time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be, and he is hereby authorized and directed to prepare and submit to the City Council an amendment to Article IX, Chapter 2 of the Anaheim Municipal Code to amend said Anaheim Municipal Code to accomplish the object herein found and determined to be necessary and proper.
