1960-5859RESOLUTION NO, A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM FINDING AND DETERMINING THAT A CHANGE OF ZONE IS NECESSARY IN CERTAIN AREAS OF THE CITY, AND THAT ARTICLE IX, CHAPTER 2 OF THE ANAHEIM MUNICIPAL CODE SHOULD BE AMENDED TO ACCOMPLISH SAID CHANGE OF ZONE, WHEREAS, the City Planning C,missirn of the City of Anaheim has heretofore duly passed and adopted a resolution declar- ing its intentio to change the boundaries of the zone or zones hereinafter mentioced and described and did fix a time and place for the ho1ditg of a public hearing thereon in the manner and as presorib d in Article. IX, Chapter 2 of the Anaheim Municipal Code, and did duly hold and conduct such public h ring to consider said proposed change of zone or zo:;IF, and did r c c©ei' °e evidence and reports from persons inter sted therein and WHEREAS, within a period of forty (40) days following the final hearing thereon, the Planning Cr, mmission did duly announce by formal resolution its findings of f .cts -.nd dcclar its opinions and reaso s for reaemm nding en amendment t said Article IX, Chapter 2 of the Anaheim Municipal Coda to effect the proposed changes i•i the boundaries of the zon hereinafter mentioned and described; and WHEREAS, upon r -ceipt of the report and recommendation of the City Planning Commmission, the City Council did thereupon fix the eth day of L- 1 4 s the time and the Count hamber in the ity Hi 1 of t he ty of Anaheim as the place for a public hearing upon said pr°cpos.d change of zone, and did give notice thereof in the manner nd as pro id d in said Article. IX, Chapter 2 of the Anaheim Municip" 1 Cod 9 and WHEREAS, at the tim and place; fix d for said public hear- ing, the City Council did duly hold a od conduct such public hearing and did give ::11 persons interested th; =rein an opportunity to be heard and did receive evidence and reports, and did thereupon con- sider the recommendations of the City Planning Commission;. and WHEREAS, the City Council doe find and determine that the property and area proposed to be changed from the zone in which it is now situated to a different zone, as hereinafter set forth, is more suitable for the zone or zones to which it is proposed to change said property and area and that the inclusion of said prop erty and area in such new zone or zone will increase the value of said property and area and will not depreciate the values of prop- erty in adjoining zones. NOW, THEREFORE, BE IT RESOLVED by th City Council of the City of Anaheim that all of the property and rea situated in the City of Anaheim, County of Orange, State of California„ described as follows° to wit. The Southerly 330 feet of the West half of the Northwest quarter of the Northwest quarter of Section 14, Township 4 Louth, RanEe 11 West, in Ranchos Los Coyotes, County of Orane, 'state of California, as the Northwest quarter of section lij is shown on Record of Survey Map filed in Book 23, page 45 of Records of Survey of said County; be changed from R -A. RESTDETyTIAL GRICULTUR "_L ZO B to R MULTIPLE- FAMILY RESIDEi'TIAL ZONE, upon the following conditions: 1. That the final map of Tract No. 369); subdividing subject prop- erty, be recorded in the Office of the County Recorder of Orange County, California. 2. That the owners of subject property deed to the City of Anaheim a strip of land 53 feet in width, from the center line of the street, along Knott Avenue for street widenin purposes. 3. That the owners of subject property pay to the City of Anaheim the sure of ,2.00 per front foot for street lighting purposes, in the event street lighting is not included as a requirement for the approval of the tract map. i;_. (a) That all engineering requirements of the City of Anaheim, such as curbs and gutters, sidewc.lks, street grading and paving, drainage facilities, or other pertinent work be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineer; and (b) that a bond in an amount end form satisfactory to the City of Anaheim be posted with the City to guarantee the installation of said engineering requirements. That all buildings erected on subject property shall be con- structed in accordance with the plans this day presented to the City Council and on file with the City of Anaheim. 6. That the owners of sub j ct pr•operty pay to the City of Anaheim the sum of ;?25 per dwellin unit, to be used for park and recreation pur >oses, said sum to be paid at the time the build- inc: permit is issued. 7. That all of the above conditions, with the exce:)tion of condi- tions 1yo. 4(a), 5 and 6, be corn? lied with within a period of 160 days from date hereof, or such Curtner time as the City Council may grant. BE IT FURTHER RESOLVED that the City Attorney be and he is hereby authorized and directed to prepare and submit to the City Council an amendment to Article IX Chapter 2 of the Anaheim Municipal Code to amend said Anaheim Municipal Code to, accomplish the object herein found and determined to be necessary and proper.
