A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ANAHEIM ACCEPTING A SEALED
PROPOSAL AND AWARDING A CONTRACT TO THE
LOWEST RESPONSIBLE BIDDER FOR THE FURNISH-
ING TO THE CITY OF ANAHEIM OF FABRICATED
REINFORCED CONCRETE STEEL CYLINDER PIPE
AND FITTINGS, WORK ORDER NO. 1728.
WHEREAS, the City Council of the City of Anaheim did
cause to be published in a newspaper of general circulation,
printed, published and circulated in the City of Anaheim, to
wit: the Anaheim Gazette, on the 29th day of January, 1960,
and the 5th day of February, 1960, a notice inviting sealed
proposals for the furnishing to the City of Anaheim, in
approximate quantities, the following fabricated, reinforced
concrete steel cylinder pipe and fittings, including rubber
gaskets for installation:
Item 1. 5,983 Lineal feet of 14 -inch concrete,
steel cylinder water pipe.
Item 2. 5,000 Lineal feet of 16 -inch concrete,
steel cylinder water pipe.
Item 3. 21 six -inch outlets.
Item 4. 3 twelve -inch outlets.
Item 5. 7 12 "x14 "x12 "x12" Crosses.
Item 6. 3 sixteen -inch end flanged outlets.
Item 7. 1 16 "x16 "x12 "x12" Cross.
AND WHEREAS, said notice did provide that said pipe
and fittings shall conform to and comply with either of the
detailed specifications set forth in said legal notice; and
WHEREAS, such notice inviting proposals for said
fabricated, reinforced concrete steel cylinder pipe and
fittings, including rubber gaskets for installation did
provide that said sealed proposals would be received by the
City of Anaheim at the office of the City Clerk of said City
up to the hour of 2:00 otclock P.M. on February 11, 1960, for
the furnishing to said City of said pipe and fittings, and
WHEREAS, the City Clerk of the City of Anaheim did
receive sealed proposals prior to 2 :00 o'clock P.M. on
February 11, 1960, for the furnishing of said pipe and
fittings, which proposals were opened on said date at the
hour of 2 :00 otclock P.M., in public, in the City Council
Chambers in the City Hall, in the City of Anaheim, by the
City Clerk and the City Engineer, and duly tabulated by the
City Engineer and the result thereof reported to the City
Council at its next regular meeting, for action thereon by
said City Council. That sealed proposals were received from
the following persons, firms or corporations in the amounts
set forth:

AND WHEREAS, the City Council does find that the
sealed proposal of SOUTHERN PIPE DIVISION OF U. S. INDUSTRIES,
INC., P. 0. Box C, Azusa, California, is the lowest responsible
bid for the furnishing of the fabricated, reinforced concrete
steel cylinder pipe and fittings specified in Items 1, 2, 3,
4, 5, 6 and 7 of the notice inviting sealed proposals and in
accordance with the specifications set forth in said notice
inviting sealed proposals, and that said proposal of the
Southern Pipe Division of U. S. Industries, Inc. should be
accepted and a contract awarded to said company for furnishing
said pipe and fittings to the City of Anaheim;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of the City of Anaheim that said proposal submitted by the
Southern Pipe Division of U. S. Industries, Inc. for the
furnishing of fabricated, reinforced concrete steel cylinder
pipe and fittings, including rubber gaskets for installation
as specified in the notice inviting sealed proposals therefor
and in accordance with and conformity to specifications set
forth in said notice, be, and the same is hereby, accepted
and that a contract for the furnishing of said pipe and
fittings be, and the same is hereby, awarded to said
Southern Pipe Division of U. S. Industries, Inc.; and
BE IT FURTHER RESOLVED that the award of a contract
to said Southern Pipe Division of U. S. Industries, Inc. is
declared to be for the approximate quantities set forth in the
notice inviting sealed proposals and that the actual amounts
required by the City may be more or less than these amounts;
and
BE IT FURTHER RESOLVED that said Southern Pipe
Division of U. S. Industries, Inc. be, and it is hereby re-
quired to execute a contract, in required form satisfactory to
the City of Anaheim and upon the terms and conditions specified
in the notice inviting sealed proposals and the proposal sub-
mitted by it, and in accordance with the specifications for
fabricated, reinforced concrete steel cylinder pipe and
fittings as set forth in said notice inviting sealed proposals
for the furnishing of said pipe and fittings in all required
lengths, at the prices as follows:

AND BE IT FURTHER RESOLVED by the City Council of the
City of Anaheim that said bid be, and the same is hereby, accepted
and said contract awarded for the above prices for said fabri-
cated, reinforced concrete steel cylinder pipe and fittings,
F.O.B. trench side on Anaheim Road, from Blue Gum to Well Site
No. 27, in the City of Anaheim, said pipe and fittings to be
delivered as required by the City of Anaheim; and

BE IT FURTHER RESOLVED that the Mayor and the City
Clerk of the City of Anaheim be, and they are hereby, authorized
and directed to execute for and on behalf of the City of Anaheim
with said Southern Pipe Division of U. S. Industries, Inc., a
written contract for the furnishing ofi.said pipe and fittings
hereinabove more particularly described and in accordance with
the specifications for said pipe and fittings set forth in
detail in :the notice inviting sealed proposals,'said notice
inviting sealed proposals and the terms of this resolution,
and the_ contract approved by the City Attorney of the City of
Anaheim; and
BE IT FURTHER RESOLVED that said contract shall
contain a provision that should said Southern Pipe Division of
U. S. Industries, Inc. fail or neglect to furnish said pipe
and /or fittings in accordance with said specifications and
the sealed proposal submitted by it and accepted by the City
as herein specified, it shall, in addition to any other
penalties provided in the contract documents, be liable to
the City of Anaheim. for all loss or damage that the latter may
suffer on account thereof.
THE FOREGOING RESOLUTION is approved and signed by
me this 16th day of February, 1960.
