1960-5820RESOLUTION NO. 5820 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM DECLARING ITS INTENTION TO CONSIDER AN AMENDMENT TO ARTICLE IX, CHAPTER 2 OF THE ANAHEIM MUNICIPAL CODE TOGETHER WITH CHANGES IN THE BOUNDARIES OF ZONES THEREBY ESTABLISHED BY REMOVING THE PROPERTY HEREINAFTER DESCRIBED FROM THE ZONE OR ZONES IN WHICH IT IS NOW SITU ATED AND INCORPORATING IT IN A P -L ZONE AND AN M -1 ZONE AS HEREINAFTER SET FORTH; RESCINDING RESOLUTION NOS. 5320 AND 5819; AND REFERRING SAID MATTER TO THE CITY PLANNING COMMISSION FOR A REPORT IN RECLASSIFICATION NO. F- 58- 59 -87. WHEREAS, the City Council did heretofore, to wit, on the 30th day of June, 1959, adopt Resolution No. 5320 approving a reclassification of the property therein described by removing it from the zone in which it is now situated and incorporating it in P -L and M -1 Zones, and the amendment of Article IX, Chapter 2 of the Anaheim Municipal Code to accomplish said zone change; and WHEREAS, it now appears to the City Council that un- certainty exists as to whether or not said proceedings in Reclassification No. F- 58 -59 -87 comply in all respects with the Conservation, Planning and Zoning Act of the State of California; Title 7, Chapter 3, Articles 11 and 12, and Chapter 4, Articles 1 and 2 of the Government Code of the State of California; and the Anaheim Municipal Code; and WHEREAS, in order to promote the public welfare, and in order to remove said uncertainty and to correct any errors that may exist in said proceedings heretofore taken, the City Council does find that said matter should be referred to the City Planning Commission for a further hearing and report; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that it does hereby declare its intention to amend Article IX, Chapter 2 of the Anaheim Municipal Code for the purpose of making changes in the boundaries of zones thereby established, and further declaring its intention to remove all the property and area situated in the City of Anaheim, County of Orange, State of California, described as follows, to wit: Lot 16 in Block K of the Kraemer Tract, as per map thereof recorded in Book 12, Pages 87 and 88, Miscel- laneous Records of Los Angeles County, California, from the R -A, RESIDENTIAL- AGRICULTURAL ZONE and incorporating it in the following zones, upon the conditions hereinafter set forth: That a strip of land 50 feet in width along Anaheim Road, and a strip 50 feet in width along La Palma Avenue be incorporated in a P -L, PARKING LANDSCAPING ZONE; and That the balance of the property above described be incorporated in the M -1, LIGHT MANUFACTURING ZONE, upon the following conditions: -1- F- 58 -59 -87 1. That the owners of subject property deed to the City of Anaheim a strip of land 45 feet in width, from the center line of the street, along Anaheim Road for street widening purposes; and a strip of land 53 feet in width, from the center line of the street, along La Palma Avenue for street widening purposes. 2. That all engineering requirements of the City of Anaheim along La Palma Avenue and Anaheim Road, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other pertinent work, be complied with as required by the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineer, and that said engineering re- quirements or improvements be installed at the time the property is developed. 3. That the owners of subject property either: (a) Pay to the City of Anaheim at the time said property is developed the sum of `2.00 per front foot on both La Palma Avenue and Anaheim Road for street lighting purposes, or (b) Install street lights in accordance with plans and specifications approved by the office of the City Engineer. 4. That approval of the Orange County Flood Control District be obtained with reference to the develop- ment of said property. 5. That the owners of subject property place of record M -1 Deed Restrictions approved by the City Attorney. 6. That Conditions Nos. 1 and 5, above mentioned, be complied with within a period of 90 days from the date of approval of said reclassification by the City Council, or within such further time as the Council may grant. BE IT FURTHER RESOLVED that said proposed amendment to Article IX, Chapter 2 of the Anaheim Municipal Code, change of boundaries and removing of said property from the zone in which it is now situated, and the incorporation thereof in the zones hereinabove mentioned, be referred to the Anaheim City Planning Commission, and that it be, and it is hereby, directed to hold and conduct a public hearing as required by law and to make a report of its findings, summaries of hearing and recommendation to the City Council. BE IT FURTHER RESOLVED that Resolution No. 5320, adopted June 30, 1959, and Resolution No. 5819, adopted February 11, 1960, in Reclassification No. F- 5 59 -8 7, be and the same are hereby rescinded.
